In Ireland, the highest court has dealt with a curious issue: Are subway sandwiches bread? No, the judges decided: there is too much sugar in the products, so more taxes are owed.

The Irish Supreme Court in Dublin determined that the sugar content clearly exceeds the limit values for bread in Ireland. This limit is set out in Irish tax law: staples are exempt from VAT, including bread. However, it must contain a maximum of sugar sufficient so that its weight represents a maximum of two percent of the weight of the flour. In the case of subway sandwiches, however, this proportion hovers around 10 percent, the court said this week. Therefore, the product must be classified as sweet.
The court had to deal with this issue because Irish Subway’s Bookfinders franchise had argued that the sandwiches should be exempt from VAT. The company considered that it had paid too much tax and was entitled to a refund. However, this was denied him with the verdict. The Subway chain, based in the US, has branches in more than 100 countries around the world.
