The editor “Austria” is appealing and is now suing the head of the Upper Austrian FPÖ, Manfred Haimbuchner.
The head of the FPÖ, Norbert Hofer, has won a first instance procedure against the publisher “Austria” Wolfgang Fellner before the Vienna Commercial Court. The reason was that he had said on one of his television shows that Hofer was giving his Ash Wednesday speech at Ried im Innkreis in “Adolf Hitler Hall or whatever it is called there.” The court lacked the factual basis for the statement, did not accept the motive of a joke and saw Hofer move to the vicinity of a crime.
Fellner and the owner medium of “Oe24.tv” were instructed to refrain from making such statements, revoke them on the “Die Insider” program and bear the procedural costs of a good 4,300 euros.
Fellner goes to the second instance
Fellner announced at lunchtime Tuesday that he wanted to make the revocation “humorous” but still go to the second instance. It was never said against the head of the FPÖ that a joke should be allowed. But if the humor is lacking, it’s on both sides. Therefore, Fellner now wants to sue Upper Austrian Deputy Governor Manfred Haimbuchner (FPÖ) because he alleged he had “roof damage” in Ried.
FPÖ Secretary General Michael Schnedlitz was pleased in a broadcast on the Commercial Court decision: “It was important for us to draw a clear line here and not allow the FPÖ and its president to get close to National Socialist ideas.” .
