The threat of punishment for hurtful photos is necessary, says Justice Minister Alma Zadić in an interview with the “press”. However, the coalition has not heard anything more about pre-trial detention. And Zadić wants to host refugees from Moria: “I know how helpless you feel.”
Die Presse: In the fight against hate on the Internet, the judges will decide in the future urgently. Isn’t there a risk that a decision will be made without looking closely at the case?
Alma Zadić: We have based the new emergency procedure on the existing claim procedure, in which a payment order is issued against a debtor without negotiation. Here it is similar: but if someone thinks that what has been said is freedom of expression and is unduly obliged to pay the court fee (107 euros) and suppress the post, they can quickly raise an objection. Then it comes down to normal legal procedures.
But the quick decision should also be reasonably correct. Can the judges cope with the extra effort without additional staff?
If we have a standardized form in which the post is clearly displayed, for this reason I see that my human dignity is being violated, then the judge checks and decides if this is plausible or not.
