On the night of October 11, 2019, the defendant struck his girlfriend at the time for the first time in their shared flat in Vienna-Wieden and raped her in a particularly brutal and humiliating way, causing her serious injuries: multiple broken bones, a bruised skull and bleeding in his ear. He then dragged the naked, unconscious woman onto the street and left her between the cars parked on the road.
If the 26-year-old hadn’t come to the aid of a walker who came out with his dog around midnight and accidentally discovered the woman immobile, he likely would have choked on the blood that had collected in his mouth and throat. The jury unanimously agreed that the defendant, who simply left her helpless partner to their fate, acted with conditional manslaughter. Six previous convictions and the particular brutality of the crime were considered as aggravating when determining the sentence.
The court based the admission to an institution for mentally abnormal lawbreakers on an opinion of psychiatric expert Peter Hofmann. As the latter pointed out, the accused committed acts of violence from an early age. The now incriminated behavior represents a “new high point,” the expert said. The 25-year-old had a personality that made people fear “that there is a very high probability that he will commit such acts again.” Corresponding treatment to contain the danger posed by the 25-year-old is only guaranteed when measures are taken, Hofmann said.
Experimented with drugs
The defendant adhered to the responsibility he had chosen when the trial opened in July. Due to previous drug use, he could no longer remember the violence. The couple met at a techno party six months before the event. “I was madly in love with her,” the 25-year-old said. Just a month later, the 26-year-old moved into their shared apartment. “We have already discussed it, but everything was normal, there were no big discussions,” said the man. They often experimented with drugs, “it happened that afterwards we could not remember”.
After consulting his defense lawyer, the 25-year-old filed a motion for annulment and an appeal against the sentence. The prosecutor waived his right to appeal.
