The bloody crime of December 8 of the previous year marked the end of a long-standing relationship. According to the indictment, the couple met in 2005, and since 2007 they shared a rented semi-detached house in a commercial town in the Mistelbach district, which would become a crime scene twelve years later. In the end there were repeated disputes between the childless couple together, topics included household chores and a lack of common interests. Furthermore, because the 48-year-old woman had met another man on the Internet in the fall, she ended her relationship with the defendant about a week before his death, according to the prosecutor. The woman went out to look for an apartment because the accused, who had been unemployed since 2007, did not want to leave the common house.

The 48-year-old man was not home on the afternoon of December 8, according to the indictment, the defendant spent the time consuming alcohol and cannabis herbs, which he is said to have used regularly anyway. When the woman returned, an argument developed in which the defendant allegedly took action. The stateless man is said to have stabbed her victim six times with great force with a kitchen knife with a 15-centimeter blade, injuring her stomach and chest. After that, the man made several minor cuts. The defendant did not help his partner. According to the autopsy, the 48-year-old died of cardiovascular failure as a result of internal bleeding.
The new man in the life of the victim, who lives in Germany, alerted the police in the afternoon of December 8, because he had been concerned after several phone calls with the woman. In the building around 9:15 pm, agents found the defendant with multiple criminal records and the body of the 48-year-old man. The 54-year-old immediately made a kind of confession and said, “You six, uh, what happened. Des do, I liked it.”
Immediately after the arrest, the defendant refused to allow an alcohol test. Then the prosecutor ordered a physical examination in the form of blood tests. “Assuming the crime happened at 5.30 pm, it was three per thousand,” said defender Manfred Arbacher-Stöger, who came to a different conclusion. He launched an attack on his client in a state of total intoxication. The 54-year-old has “drunk so much that he no longer knows what he is doing: the so-called tear of the film.” The defendant had “probably more criminal record than everyone in the room”, but this was mostly due to an extremely difficult childhood or complex life history. The accused had often been abandoned and could not bear another disappointment.
The psychiatrist Peter Hofmann spoke of a kind of inclined idyll in relation to the relationship between the accused and the victim. For years, the couple had “almost led a retirement life without great activities or high levels of social media,” Hofmann said. However, due to disputes among other things, this idyll went in the direction that the subsequent victim wished to separate from the stateless person. The 54-year-old faced social nothingness and started drinking again.
