The controversial rally and rally against the crown policy may take place in Berlin on Saturday. The Berlin Higher Administrative Court (OVG) confirmed early Saturday in the second instance that the Berlin police ban will not last. This decision is now final.
The state of Berlin did not want to accept approval of the demonstration scheduled for Saturday by opponents of Corona’s requirements. Therefore, the police authority had called the Higher Administrative Court (OVG) in Berlin.
On Friday, the administrative court overturned the general ban on demonstrations and allowed large-scale demonstration under various conditions. Organizers must ensure safety distances are observed and make appropriate announcements over the loudspeaker. Spacious barriers should be erected around the stage, and barriers were also installed around the video screens that broadcast the events on stage. However, a blanket ban is not justified, the administrative court ruled.
Since the OVG now also allows the meeting under strict conditions, the organizers can still appeal to the Federal Constitutional Court in Karlsruhe to defend themselves against the conditions of the meeting. However, it is not yet known if they intend to do so. The state of Berlin, on the other hand, could not go to Karlsruhe, since as a state body it cannot invoke fundamental rights.
