In the opinion of the Federal Court of Justice, many owners of a VW car could, in principle, be compensated for the damage caused by the diesel scandal.

Top judges showed in a skeptical preliminary assessment by Volkswagen (VW) dealership on Tuesday that diesel owners were not hurt by illegal exhaust technology in their vehicles. Specifically, the proceedings are about the lawsuit of a VW Sharan owner who wants to return his car and get the full purchase price back because he is cheated by VW. It is the first VW diesel scandal heard by the Federal Court of Justice.

The Koblenz Higher Regional Court had seen VW’s behavior as intentional, contrary to morality, but had only awarded the plaintiff the amount claimed. In contrast, both sides had appealed. The Federal Court of Justice wants to announce its ruling at a later date.

VW Comments

The automaker is critical of parts of an initial assessment by the Federal Court of Justice (BGH) regarding the diesel matter. The question is whether buying cars with the EA 189 scandal engine could be considered concrete harm to customers. “Contrary to the preliminary opinion of the German Federal Court of Justice, we do not believe that just buying a vehicle is harmful,” a company spokesman said on Tuesday.

Diesel cars were always usable: the risk of dismantling “never existed”. The suggestion by the Karlsruhe judges that at least an amount for car use had to be collected by affected customers was approved.

VW shares temporarily increased 4.71 percent in XETRA operations to 126.74 euros.
