The American Republicans have suffered a defeat in the Supreme Court in the dispute over the vote by mail in the next presidential elections. President Donald Trump’s party had filed a motion to extend the deadline for counting electoral documents in the state of Pennsylvania. Due to a four to four vote tie among the Supreme Court justices, the motion failed.
Republicans wanted to reverse a court order that documents with the correct postmark must be counted three days after the actual date of the election – that is, before November 6. Pennsylvania is known as the swing state, in which sometimes Republicans, sometimes Democrats, win in elections. The result in undecided states will be decisive for electoral victory.
Pennsylvania is one of the particularly competitive states, neither for Trump nor for challenger Joe Biden of the Democrats is there a clear majority. In 2016, Trump won in Pennsylvania by just 44,292 of the more than 6.1 million votes against his Democratic opponent Hillary Clinton.
Due to the coronavirus pandemic, more citizens than usual are expected to make use of the early voting or absentee vote option in US elections. Trump has been raising his spirits against voting by mail for months because he allegedly sees huge potential for fraud in it. There is no evidence to support their claims.
Trump’s opponents accuse him of preparing the ground with his statements to challenge the electoral result after a possible defeat. In late September, Trump said he expected the Supreme Court to decide the election. That is why the president of the United States is pushing for the swift replacement of the ninth post of justice on the Supreme Court to consolidate the conservative majority.
Currently only eight Supreme Court justices
After the death of Justice Ruth Bader Ginsburg, there are currently only eight justices on the Supreme Court, which is the only way to make a tie. In the future, Trump’s Supreme Court candidate, conservative attorney Amy Coney Barrett, could play a decisive role in such situations.
Trump and his Senate Republicans want Barrett to take office before the November 3 presidential election. The court often has the final say in litigation over politically controversial issues, such as immigration, abortion rights, or health care.
