An LKH Hochsteiermark doctor had to answer for wrongful death in Leoben court.
A doctor from LKH Hochsteiermark is said to be responsible for the death of an 18-year-old woman. The patient was receiving hospital treatment in October 2019 due to a benign head cyst. Then they sent her home and she died of brain swelling.
In Leoben court, the doctor was sentenced Thursday to a fine and four months’ suspended prison. During a hospital stay in the neurology department at LKH Hochsteiermark, a benign colloid cyst was found in the brain of a young woman. The patient had been treated for migraines for several years. After a week, the 18-year-old was released from the hospital. An operation should take place in December.
Unrecognized hazard
The night after his release, the boy developed a severe headache and vomited. So he drove back to the LKH and the now-accused doctor was notified. According to the prosecutor, he did not recognize the danger and only diagnosed him with a migraine attack.
The patient received a pain infusion. As the doctor told Judge Roman Weiss, he recommended hospitalization.
The doctor pleaded not guilty
However, after the second infusion, the young woman’s condition improved and she was allowed to go home. It was also the wish of the patient. The doctor has pleaded not guilty.
The next day, the 18-year-old died. As the autopsy discovered, the cause was inflammation of the brain. The victim’s mother reported at trial that her daughter had received three infusions and the doctor said it was a violent migraine attack.
The prosecution accused the defendant of having to admit and monitor the patient for the previously diagnosed colloid cyst. Then the life-threatening condition would have been recognized.
The doctor was found guilty. The verdict: four months of conditional prison and a fine of 14,400 euros. The defendant immediately announced her appeal. The judgment is not final.
