An NJ federal judge has rejected a challenge to the Trump campaign’s state’s mail-in voting plans.


A New Jersey federal judge has reprimanded Trump’s campaign for trying to block the state’s new mail-in voting rules, including one that could count votes two days after election day even if they don’t have a postmark.

On Tuesday, Judge Michael Ship rejected the campaign’s request for a preliminary injunction, ruling that the state acts within its authority to issue rules.

“Although federal law prohibits New Jersey from voting after election day, it is prudent to choose New Jersey’s methods of determining the timing of voting, unless there is a significant risk of premature ballot stuffing,” the court ruled. .

Citing the case law, the judge upheld the right of New Jersey voters to take the desired action to protect people exposed to COVID-19, saying decisions related to “public safety and health” are left to elected officials.

Ship also said the campaign failed to show the potential for irreparable damage if the rules were followed.

The second rule, taken from the campaign challenged in the lawsuit, allows the state to begin the voting process as early as 10 days before election day, without tall reports. Sheep said the state would be allowed to do so until the results of that ballot are announced until the polls close. Most states allow pre-canvas launches at least one day before election day, and legislators in swing states like Pennsylvania and Michigan are pushing for the ability to do so without delay in determining election results.

The decision does not technically end the decision, but in less than a month until election day, it is important for the state to uphold the current rules, except for a quick and successful appeal from the Trump campaign.

New Jersey Attorney General Gurbur Grewal celebrated the decision.

“Big win for New Jersey voters! Today a federal judge rejected a challenge to NJ’s new election laws,” Grewal tweeted Tuesday. “As your AG, I will continue to fight for your right to vote and your right to be healthy. You should not have to choose.”

Fox News reached out to Trump’s campaign for comment, but he didn’t respond immediately.

Meanwhile, the state is already experiencing problems as some residents have turned out to vote for people who have fled the state and dead voters, but some election officials say they are confident anti-fraud measures will take care of it, according to local reports.

Local elections in the city of Patterson, NJ, also made national headlines earlier this year after several individuals, including the winner of a city council membership, were charged with voter fraud-related offenses.

Republicans had many recent court victories in cases dealing with election issues, including the deadline to accept a vote, but states involved where existing laws set voting deadlines on election day and Democrats replaced them.

The court in Pennsylvania approved such an extension, but Republicans are awaiting Supreme Court review of that decision.
