On the night of September 9, Mr. Le Anh Tuan, deputy director of the Oncology Hospital, said that this is a breach of contract caused by negligence in the export and verification process.

By reviewing all medications received at the hospital pharmacy in the past, the hospital confirmed that this was a single incident and, due to the negligence of both parties, it was not an intentional error or ‘arrest’. hand’.

Both the company and the pharmacy staff did not compare the terms of the signed contract but only verified the quality, quantity according to the order and the expiration date for delivery.

All Senoxyd-Q10 drugs for daily delivery 24-2-2020 include 30,000 tablets, with a shelf life of 3-6-2020.

This drug has a shelf life of more than two years, but until the date of purchase at the Oncology Hospital pharmacy, it is only valid for more than 3 months.

However, as of April 28, these medications have been fully delivered to patients while their expiration date is in accordance with the law.

The hospital has conducted a related staff review and has a penalty for breach of the company’s contract.

The hospital also informed the inspector of the Ho Chi Minh City Health Department.

Previously, the Oncology Hospital had signed a contract in principle with Delap Saigon Joint Stock Company, at No. 402 Nguyen Duy Duong, P9, District 10 (HDC No. 08 / HDNT-2020 / BVUB-Delap dated 4/7 / 2019) on the purchase of Senoxyd-Q10 drugs.

In the main contract, there is a term that binds the responsibility of Party B (Delap Saigon Corporation) “agrees to the remaining expiration date of the drug from the time of supply to Party A with a minimum remaining warranty. 6 months for drugs with a shelf life of 2 years or more; 3 months for drugs with a shelf life of 1 to 2 years; ¼ of a drug with a shelf life of less than 1 year. ” The above provision not only applies to this contract, but BVUB Pharmacy also includes it in all other procurement guidelines.

“Adding a shelf life of 6 months to a drug with a shelf life of more than 2 years in the contract is to ensure that the hospital pharmacy has a minimum enough time to supply the drug to the patient while the drug is still available. according to the law. Reduce waste due to expired drugs that need to be canceled “- emphasized Mr. Tuan.

However, in accordance with the main contract and in accordance with the general regulations of the Oncology Hospital Pharmacy, the delivery of this drug is not in accordance with the contract. Negligence is due to a lack of coordination in the parties related to the delivery of drugs when the direct recipient of the drug does not know the content of the contract.

The hospital also had a meeting with the Delap Saigon Joint Stock Company. The company admitted that there were errors because the store manager did not verify the terms of the contract in principle, but found that the drug was still expired, would be delivered to the delivery staff and delivered to the hospital pharmacy.

The Board of Directors of the Hospital decided to impose a sanction on the company that “required the company not to bid, to supply drugs to the pharmacy of the Oncology Hospital and to the Pharmacy department of the Oncology Hospital within a period of 12 months.” from 9-9-2020 “.

Following the incident with the Senoxyd-Q10 drug, the hospital allowed all relevant staff to learn from the experience and was reminded to comply with the drug registration process.

In the coming period, the Hospital Pharmacy will continue to improve processes, increasing the application of information technologies in the management of imports and exports, management of the use of drugs, and promoting inspection, supervision and coordination. .
