The emails provided to the defendant Chung are documents that the defendant Dung acquired during the examination and extraction of electronic data from the Mac computer in the Nhat Cuong Company case on July 1. After that, the defendant Dung actively copied these documents from earlier and then saved them on his personal computer.

Then on the night of August 25, 2019, Dung informed Mr. Chung to receive the documents obtained when he verified and restored the software system of the Nhat Cuong company. On the same day, under the direction of Mr. Chung, Nguyen Hoang Trung drove to the lobby of the apartment where Dung resided to receive the envelope containing the documents and then take it to Mr. Chung’s home.

On the morning of June 10, the defendant Dung continued to transfer 3 documents in the list of state secrets at the “Confidential” level to Mr. Nguyen Duc Chung through the Viber application. These documents include: Report on the results of data extraction and payment of contraband goods for 16 suppliers of the Nhat Cuong company; documents to inform Vice Minister Nguyen Duy Ngoc on progress, results, plans to conclude the investigation of the case at the Nhat Cuong company and report on the results of the verification that the Nhat Cuong company provides public services to the city. Article 337. Crime of intentional disclosure of State secrets; the crime of appropriation, purchase, sale or destruction of secret State documents

d) Damage the political regime, independence, sovereignty, unity and territorial integrity.

4. Violators may also be subject to a fine of between 10,000,000 and 100,000,000 VND, the prohibition to occupy certain positions, exercise certain occupations or perform certain jobs for between 1 and 5 years.
