For Mr. Tuyen, the investigating agency said that as Vice Chairman of the Ho Chi Minh City People’s Committee and his subordinates had seriously violated the regime of administration and use of state property.

In 2016, the Vice President signed a decision approving Sagri to transfer the Phuoc Long B residential project, District 9, to Phong Phu Joint Stock Corporation for more than VND 168 billion (equivalent to more than VND 10.5 million). VND / m2) – lower than the market price, causing serious damage to the state. This decision was based on Mr. Tuyen’s advisory report, the Construction Department proposal signed by Director Tran Trong Tuan.

In this project, Sagri uses 3.75 ha of cooperative land with a capital contribution value at a rate of 28%, Phong Phu Corporation is 72%. The transfer of the contributed capital (in fact, the transfer of the right to use the project land with the complete technical infrastructure) to Phong Phu Joint Stock Corporation, but not through an auction to determine the market value, is a violation of the Decree . 91/2015 of the Government on investment of state capital in companies; management and use of state capital to invest in production and business in companies.

The fact that Sagri did not contract a price appraisal when transferring the project was also considered a violation of Government Decree 91/2015; The signing of a business cooperation agreement with Phong Phu Corporation on profit sharing (a fixed rate that does not depend on business results) is not a guarantee of Sagri’s interests.

When the bug was discovered, the Ho Chi Minh City People’s Committee issued a decision to revoke and cancel the previously approved decision to transfer the project. Sagri and Phong Phu Corporation have to pay, hand over what they received from each other before, and “promise not to question anything later.” However, this was not done due to the investigation and arrest of Mr. Le Tan Hung by the Ministry of Public Security.

“The defendants in the process of carrying out criminal acts have had sophisticated and cunning tricks. In Resolution No. 6077 / QD-UBND that approves the transfer of the entire project, then it is delivered to the relevant departments and branches. to avoid criminal responsibility ”, affirmed the conclusion of the investigation.
