Earlier, responding to citizens about the licensing of this “strange” project, Mr. Bui Thanh Binh – Head of the Urban Management Department of the Ba Dinh District People’s Committee – cited some rules and documents, however, according to lawyer Dang Xuan Cuong, TAT (Hanoi Bar Association) law firm, the rules from 16 years ago have been canceled and are sub-legal documents.

Lawyer Dang Xuan Cuong said that the application of Vietnam’s 323: 2004 rule canceled is not in accordance with the law. The current regulation 08.2009 / BXD cited by the Ba Dinh District People’s Committee has been canceled and is no longer in force.

Lawyer Le Hang (Hanoi Bar Association) said that currently all projects with basements are required to apply for Ministry of Construction Circular 03 issued in 2016, as amended in 2019. Consequently, Grade III buildings (detached houses) They can only be built with 1 basement, the depth is less than 6m.

“For grade II buildings with a large floor area, high demand, such as apartment buildings, shopping centers, public works … based on new purposes of use, 2 – 4 basements are licensed. Level III works that level up to 4 basements are not in accordance with current regulations “- said lawyer Le Hang.

Many architects and urban planning experts also expressed concern about this underground work. Because the underground works are row houses, having up to 4 basements will set a bad precedent for underground space not only in Hanoi, Ho Chi Minh City but also for Vietnamese cities.

The total area of ​​the basement is up to 1,070.8 mtwo, almost half of the construction area. The investor in this project is Major General Le Cong and Ms Vuong Thi Lan Anh.
