According to the head of the Dan Phuong District People’s Court, after the decision to bring Phu Le and two young men to trial, the victim in the case requested to withdraw his request for prosecution.
“Immediately after the defendant filed the petition, the court issued a decision to suspend the trial, suspend the case and carry out the procedures to release the three defendants. Phú was released on bail,” the leader said.
Speaking about the withdrawal of the prosecution petition, Ms. Tran Thi Dao (also called Dao Chile, 30, a resident of Dan Phuong district) said that because Phu Le’s father was seriously ill, his family He withdrew the request so that Phú could take care of the father. Additionally, Phu Le’s family also compensated and beat the victims.
As expected, the trial of Phu Le and the two young men will take place on December 15 at the headquarters of the Dan Phuong District People’s Court.
According to the indictment, Phu Le was living as husband and wife with La Thuy Kieu (35, resident in Cau Den neighborhood, Hai Ba Trung district, Hanoi). The two regularly go to live social media that attracts many people to meet and eat, bragging about images that lead to conflict, cursing with another group on the network.
At the end of July, La Thuy Kieu and Tran Thi Dao had an online sales conflict. These two people repeatedly filmed insult videos, challenged each other, and made appointments to resolve conflicts.
The prosecution found that on the morning of August 2, 2020, Phu Le and Kieu called Dao to make an appointment to meet in Dong Anh district to resolve the conflict.
When he arrived, Dao did not see Phu or his wife, but he saw many young people from Phu gathered, so they returned. On the evening of the same day, Le Van Phu and La Thuy Kieu and a group of young people went to eat and drink. Here, Hoang Van Thuy proposed to go to Ms. Dao’s house to hit this woman’s face. Phú agreed and said “if he knew Dao, he would hit him, otherwise he would hit Dao’s mother and aunt but prevent the exit.”
On the morning of August 3, Thuy and Tran Van Tu rode a motorcycle to Dao’s home in Dan Phuong district. Two suspects used an iron pipe to attack Dao’s mother, Ms. Nguyen Thi Nga, causing the victim to wound 1%, and Ms. Be (Ms. Nga’s sister) was slightly injured.
Under Clause 1, Article 155 of the 2015 Code of Criminal Procedure, prosecute only criminal cases for crimes specified in Clause 1, Article 134 (intentional injury), 135, 136, 138, 139, 141, 143, 155, 156 and 226 of the Penal Code at the request of the victim or representative of the victim is a person under 18 years of age.
However, in Clause 2 of Article 155 of the Criminal Procedure Code of 2015, the person who requested the processing has the right to withdraw the request. When the person who has submitted the request for processing withdraws their request, the case should be discontinued.
