On March 4, information from the Ministry of Public Security said that the investigative police agency issued a decision to prosecute the defendant against Le Van Thanh (59 years old, former deputy head of the Ho Chi Minh City People’s Committee Office) and Nguyen Thanh Chuong. (47 years old, former head of the urban office of the Ho Chi Minh City People’s Committee Office) was prosecuted for “violating the regulations on the administration and use of state property, causing loss and waste” according to Article 219 Penal law 2015.
Defendant Nguyen Thi Thanh An (54, former controller of the Saigon Agricultural Corporation) was indicted for “irresponsibility causing serious consequences” under article 360 of the 2015 Penal Code.
The decisions to prosecute the accused have been approved by the Supreme People’s Prosecutor’s Office.
According to the initial investigation, Le Van Thanh and Nguyen Thanh Chuong reported the wrong proposal, prompting the Ho Chi Minh City People’s Committee to issue a decision to allow the transfer of the Phuoc Long B (District 9) project between the Corporation. Saigon Agriculture and Phong Phu Joint Stock Corporation went against regulations, causing nearly 700 billion VND damage to the state.
The defendant Nguyen Thi Thanh An is a controller, failure to fulfill his duties as prescribed, leading the defendant to transfer the project illegally, causing damage to the state.
As for the case that occurred at Saigon Agriculture Corporation Limited (SAGRI), so far the investigating agency has prosecuted a total of 16 defendants.
Previously, 13 defendants were prosecuted in this case for “violating regulations on the management and use of state property, causing losses and waste” and “misappropriation of funds.”
Before the decision to prosecute, the Municipal Inspector issued inspection findings, pointing out many deficiencies and errors in compliance with the law in the management and use of the land; financial management and use; execution and transfer of projects in SAGRI.
In which, the land management violations occurred in previous terms, while the administrative and management violations belonged to Mr. Le Tan Hung, former CEO of SAGRI. In addition to the aforementioned crime, Mr. Hung was also investigated for “embezzlement”.
