Two Republicans sued the Montgomery County elections official for illegally counting mailed ballots and correcting them.
The lawsuit was filed by Kathy Barnette, Republican candidate, and Clay Breece, chairman of the Berks County Republican Party, in Eastern District Court, Pennsylvania, on November 3.
“In Montgomery County, the board of elections not only went against the standards set forth in the Pennsylvania Election Law, but it also superseded and enforced its own authoritarian standards by illegally verifying mail-in ballots received before 3 May November. In certain cases, providing voters with such illegal ballots prior to counting is considered a lack of reelection opportunity on or before November 3, “the lawsuit said.
Pennsylvania has yet to complete the vote count and President Donald Trump is ahead. However, there are predictions that the results will tilt in Biden’s favor as the millions of uncontrolled mail-in votes in the state.
The lawsuit also claimed that Montgomery County counted mail ballots and absentee ballots at 7:00 a.m. on Election Day 3/11, but found deficiencies in these ballots and contacted some voters to change their ballots. The plaintiffs asked a federal judge to withdraw about 1,200 ballots that they believed had been submitted in error and subsequently modified.
“Plaintiff is running as the fourth Republican candidate for Congress and will be at a significant disadvantage because the fourth congressional district includes Montgomery and Berks counties.” said. “A vote that can be counted in Montgomery County will not be counted in Berks County because the defendant’s decisions violate Pennsylvania Election Law and Supreme Court regulations.”
Kelly Cofrancisco, a spokeswoman for Montgomery County, stated that the county believes its process was “correct and permissible under the Election Law.”
Bob Bauer, Biden’s campaign adviser, said Monday that any Republican legal challenge to stop counting mail-in ballots in Pennsylvania would be “the goal of a fool.” Bauer also called the Republican lawsuit “frivolous attacks.”
