According to the conclusion of the investigation, Diep Bach Duong Company (represented by law by Ms. Duong Thi Bach Diep) is headquartered at 179 bis Hai Ba Trung, Hall 6, District 3, HCMC; The light music center (under the Department of Culture, Sports and Tourism of Ho Chi Minh City) is assigned to manage the headquarters at 185 Hai Ba Trung, Ward 6, District 3, HCMC.

Due to the deterioration of this facility, in 2007, the Light Music Center contacted Diep Bach Duong Company to cooperate in the investment and improvement of the venue.

Since then, Ms Diep proposed to the Light Music Center to find another equivalent property to exchange the land for 185 Hai Ba Trung and it would merge with the 179 bis, 181 and 183 Hai Ba Trung land to create a 5-star hotel complex.

In return, Diep Bach Duong Company will support the Light Music Center to rebuild the center in another suitable and more modern location. Seeing the reasonable plan, Mr. Vy Nhat Tao agreed to this exchange plan.

After that, Ms Diep found land at 57 Cao Thang (District 3, Ho Chi Minh City) and submitted a property exchange request to the Ho Chi Minh City People’s Committee and related agencies to request the land exchange 57 Cao Thang take land 185 Hai Ba Trung; and Diep Bach Duong Company will support the Center for Light Music for VND 5 billion.

However, in the previous proposal, the leaders of Ho Chi Minh City do not accept the exchange, because the law does not contemplate this provision.

After that, Ms. Diep continued to advocate for competent people in the exchange plan, along with a proposal to repair the Light Music Center in the amount of 20 billion VND. After that, Mr. Vy Nhat Tao invited Mr. Nguyen Thanh Rum to visit Cao Thang site 57 and introduced Mr. Rum to the benefits of the Light Music Center. Mr. Rum held a meeting of the Board of Directors of the Department of Culture, Sports and Tourism and agreed on the exchange policy.

In fact, with real estate number 57 Cao Thang, Ms. Diep promised that she would borrow money at the Agribank Ho Chi Minh City branch. The conclusion of the investigation clearly establishes that the defendant Duong Thi Bach Diep has committed a deceptive act by using the land at 57 Cao Thang Street, as collateral, to exchange with the property number 185 Hai Ba Trung and have many other fraudulent acts to hide the mortgage on a real estate property at 57 Cao Thang Street with a loan at Agribank Ho Chi Minh City Branch, as well as the mortgage at Phuong Nam Commercial Joint Stock Bank (later renamed Sacombank), so far unable to afford to repay; the appropriation is complete; The value of assets in 185 Hai Ba Trung as of January 2019 was more than VND352 billion.

Furthermore, according to the conclusion of the investigation, the conduct of the defendant Duong Thi Bach Diep committed the crime of “fraud and appropriation of property”, as defined in Clauses 4 and 5 of article 174 of the Penal Code of 2015, such as gambling is the mastermind.
