Advance 25 billion to buy land
According to the indictment, in 2009 defendant Trinh Xuan Thanh, chairman of the PVC Board of Directors, spoke with defendant Do Van Hong, director of Taoyuan Construction Co., Ltd. to establish Kinh Bac Petroleum Construction and Investment Joint Stock Company. (Beijing PVC).
In August 2009, PVC signed a contract with PVC Beijing for the construction of various items for the Dinh Vu – Hai Phong polyester factory project.
During the process of implementing the Beijing PVC contract, Trinh Xuan Thanh discussed with Do Van Hong the purchase of land to invest in the construction of a resort. Both surveyed and agreed to buy a 3,400 m parcel of land2 in the city of Tam Dao (Vinh Phuc).
Trinh Xuan Thanh and Do Van Hong agreed on a plan to direct PVC to Beijing Bac PVC to advance 25 billion to have money to buy land.
In June 2010, at the handover meeting at the Dinh Vu polyester fiber factory construction site, Trinh Xuan Thanh ordered PVC to deliver VND 25 billion in advance to Beijing PVC.
From the Trinh Xuan Thanh leadership, Mr. Vu Duc Thuan, former CEO of PVC, had a pen to agree with the proposal to promote PVC Beijing Bac.
Mr. Nguyen Huy Hoa, Deputy General Manager of PVC and Nguyen Thanh Son, Chief Accounting Officer signed a payment order to transfer VND 25 billion from the PVC account to Kinh Bac PVC.
After PVC paid him 25 billion in advance, Do Van Hong used almost 24 billion to transfer to Mefrimex to pay for the 3.4 billion purchase.2 land on Tam Dao.
In July 2010, the Vinh Phuc Province Department of Natural Resources and Environment issued a certificate of land use rights on the aforementioned lands to Kinh Bac PVC.
After buying the land in Tam Dao, Trinh Xuan Thanh and Do Van Hong agreed to increase the charter capital of Kinh Bac PVC from 50 billion to 150 billion.
Although the PVC Board of Directors has not met to consider the possibility of increasing the registered capital, Trinh Xuan Thanh still signed a letter to PVC Beijing with the content: “Approval of the plan to increase the registered capital of Beijing PVC from 50 billion from VND to 150 billion VND “. .
In order to validate the 25 billion amount used to purchase land, Trinh Xuan Thanh and Do Van Hong agreed to convert the advance money in PVC’s equity contribution into Kinh Bac PVC.
Transfer around
With the purpose of owning 3,400m2 of land2Trinh Xuan Thanh asked Do Van Hong to transfer it to him for 23.8 billion.
To do this, Trinh Xuan Thanh established the Mai Phuong Company and asked her biological father, Mr. Trinh Xuan Gioi, to act as owner.
After that, Do Van Hong signed a contract to transfer 3,400 square meters of land.2 for the Mai Phuong company.
However, Trinh Xuan Thanh took advantage of the position of chairman of the PVC Board of Directors, influencing the PVC Beijing operation, so he only paid to buy the mentioned 20.8 billion land and 3 billion did not pay. So far, in the PVC ledger system, Kinh Bac still records the amount of 3 billion VND as a receivable from Mai Phuong Company.
After receiving the transfer from Kinh Bac PVC, Mr. Trinh Xuan Gioi continued to transfer the entire Mai Phuong company, including the above-mentioned parcel of land, to Trinh Xuan Thanh’s wife, Tran Duong Nga.
In June 2016, Trinh Xuan Thanh’s wife continued to transfer the company to Mr. Kieu Dao Lam (who resides in Vinh Phuc) for VND 45 billion.
At the end of 2017, the investigation agency carried out a village distraction in the aforementioned Tam Dao land of Trinh Xuan Thanh.
In June 2018, the security and investigation agency of the Ministry of Public Security canceled this decision, but sent a written request to the Department of Natural Resources and Environment of Vinh Phuc province and the functional units to suspend the transaction and transfer. of the plot. land.
