In February 2020, the defendant Nguyen Thanh Tuyen, an employee of Phuong Dong Medical Equipment Co., Ltd. (Phuong Dong Company), actively contacted Mr. Nguyen Nhat Cam to “bid” on the testing system. COVID. -19 for 7 billion.

Nhat asked Tuyen to help him sell this machine to his company at a maximum price of 4 billion so that Nhat would sell it to CDC Hanoi for 7 billion.

Tuyen and Nhat argued that if the “deal” is successful, he will pay Mr. Nguyen Nhat Cam 10%, the remaining difference will be divided by the two defendants.

On February 6, defendants Nhat and Tuyen went to see Mr. Cam in his office, who through negotiation agreed to purchase a real-time PCR system for 7 billion VND.

Defendant Tuyen also suggested that Phuong Dong Company would not participate in the bidding, but assigned Nhat to find a qualified contractor to implement the package and obtain Mr. Cam’s approval.

After the discussion, Tuyen left, while Nhat stayed and agreed with Mr. Cam that the completed “deal” will pay Mr. Cam 15% of the value of the system.

After that, the defendants bought and sold Phuong Dong Company’s Realtime PCR system through various other companies, using many tricks to “blow up the price” and raise the system from 2.3 billion VND to CDC Ha. Price internal 7 billion.

According to the conclusion of the investigation, he was aware that his behavior was incorrect, not in accordance with the provisions of the Tender Law, causing damage to State property for more than 5.4 billion VND.

However, defendant Cam did not admit that defendant Nhat exchanged a deduction to CDC Hanoi of 15% of the value of the package. Therefore, the investigating agency has not had sufficient grounds to show that the accused has a self-interest.

At the investigating agency, the defendant Tuyen informed the director of the Phuong Dong company, Nguyen Xuan Thanh, about the results of the meeting with Mr. Nguyen Nhat Cam. Defendant Tuyen asked Mr. Thanh for the price reduction and agreed to sell the device to Nhat’s party for 3.7 billion.

Mr. Thanh confessed that Tuyen reported that he had met with Mr. Nguyen Nhat Cam to introduce the automated real-time PCR system. After that, Tuyen’s commercial department arranged for Mr. Thanh to sign a contract to sell this system for VND 3.7 billion to Hung Long Company.

However, Mr. Thanh did not acknowledge that Tuyen’s price of 7 billion VND to CDC Hanoi, did not know that the defendant Nguyen Nhat Cam agreed to determine that the MST Company was appointed to the contractor in contravention of regulations, which which resulted in damage to state property. .

The investigating agency determined that Mr. Nguyen Xuan Thanh used the Phuong Dong Company legal entity to import the Realtime PCR system for 2.3 billion. Mr. Thanh agreed with Nguyen Thanh Tuyen, helping Nguyen Ngoc Nhat to conclude, collude with Nguyen Nhat Cam, and complete the bidding documents for the illegal MST company.

“Mr. Thanh is the one who signed a contract to sell the machine system for 3.7 billion VND to Hung Long Company, helping MST Company raise the price short to sell it to CDC Hanoi for 7 billion illegally, causing damage to the house, the water, which seriously affected the prevention of the COVID-19 epidemic, generated bad public opinion in society ”, the investigation concluded.

The behavior of Mr. Nguyen Xuan Thanh constitutes a crime “in violation of the bidding regulations, causing serious consequences”. Based on the results of the investigation, on July 2, C03 issued a decision to prosecute the accused, a temporary arrest warrant and a search warrant against Mr. Thanh for the investigation.

However, on September 10, before C03 concluded the investigation 2 days earlier, the Supreme People’s Prosecutor’s Office issued a decision to annul the decision to prosecute the accused and not approve the arrest warrant for Mr. Thanh. .
