The remaining 4 defendants in this case are Nguyen Ngoc Nhat, an employee of Vitech Science Development Company Limited; Dao The Vinh, Director of Materials Science and Trade Company Limited of Vietnam – MST; Nguyen Tran Duy, former CEO of JSC Nhan Thanh Valuation and Auctions; Nguyen Thanh Tuyen, an employee of Phuong Dong Medical Equipment Co., Ltd.

In this case, the prosecution authorities determined that the defendant Nguyen Nhat Cam played the role of mastermind, the remaining 9 defendants played the role of accomplices. The two defendants were tried for “violating the bidding regulations, causing serious consequences”, with a penalty of 10 to 20 years in prison.

According to the accusation, taking advantage of the complicated situation of Covid-19, since February the defendants for their own interest have concluded a fraudulent agreement, raising the purchase and sale price of laboratory equipment.

Defendant Cam, as Director, President of the Procurement Advisory Council, must prepare a contractor selection plan, prepare the price of the plan, and submit it to the competent authority for approval, in accordance with the Tender Law. However, Cam did not comply with the above. Discuss with Nguyen Thanh Tuyen directly and get VND 7 billion quote, 36 months warranty.

In the meeting after that, Tuyen discussed with Cam about Phuong Dong not participating in the actual contract because there are many orders, there will not be enough staff to do. Tuyen, who supplies machines for CDC Hanoi, will assign Nguyen Ngoc Nhat for implementation.

After that, Cam ordered his subordinates, Thanh, Dung, and Quynh, to fill out the appointment documents, assigning MST as the winning bidder. To validate the contractor selection at the predetermined price, CDC Hanoi contracts with Nhan Thanh Asset Auction and Valuation Joint Stock Company to summarize the valuation certificate and complete the contractor designation procedures. .

The act of buying and selling equipment by the defendant Cam and his accomplices violated the bidding regulations, causing damage to state property of more than 5.4 billion VND. The defendants and their families have now paid the damages in full.
