According to the accusation of the “appropriation of secret state documents” that occurred in Hanoi by the Supreme People’s Prosecutor’s Office (VKSNDTC), on May 14, 2019, the Investigative Police Agency (CSDT The Ministry of Public Security processes and investigates a criminal case involving a series of violations that occurred at Nhat Cuong Trading and Service Limited Company and various related units (called a public case for short. In particular, the CSDT agency of the Ministry of Public Security identified Mr. Nguyen Duc Chung (SN 1967, residing in Trung Liet neighborhood, Dong Da district, Hanoi city), the former chairman of the Hanoi People’s Committee and his wife as the person with interests, obligations related to the case.
In order to gather information and documents on the investigation of the case of Nhat Cuong Company, Mr. Chung approved Mr. Phan Huy Le – Chairman of the Board of Members, Managing Director of Ha Thanh Co., Ltd. to introduce and get acquainted with Pham Quang Dung (SN 1983, resident of Thanh Tri district, Hanoi city, grandson of Mr. Le). Dung at this time was a police officer with the Corruption, Economy and Smuggling Crimes Investigation Department (C03), Ministry of Public Security, and was recruited to participate in the investigation of the Nhat Cuong company case.

At around 8:20 p.m. on July 20, 2019, at Mr. Chung’s request, Dung booked the car through the application for Mr. Chung’s house on Trung Liet Street, Trung Liet neighborhood. Here, Mr. Chung and Dung exchanged information about the investigation of the Nhat Cuong company case.
Mr. Chung asked Dung to provide him with information and documents related to the Nhat Cuong company case. Dung agreed and said that he currently has some documents at home and that he will print them out and send them to Mr. Chung.
At around 10:20 am on the same day, Dung left Mr. Chung’s house to go to his house and printed documents from his personal computer on paper, including 5 email copies in a sealed envelope. Dung stated that this is a document that Dung was assigned to inspect and extract data from electronic devices that the Macbook Pro seized in the case of the Nhat Cuong company on July 1, 2019.
As for Mr. Chung, after Dung left, Mr. Chung called to ask Nguyen Hoang Trung (SN 1983, residing in Hai Ba Trung district, Hanoi city) – Expert from the Secretariat, editing and also Mr. Chung’s driver came to meet and received documents from Dung.
Upon receiving “orders” from Mr. Chung, Nguyen Hoang Trung called and went to meet Dung in the lobby of the building where Dung lived. Here, Dung gave Trung a sealed envelope that contained documents.
In the indictment, VKSNDTC concluded that from July 2019 to June 2020, by implementing Mr. Chung’s proposal, Dung had appropriated 5 times 9 documents in the list of state secrets at the “Secret” level related to the case. from “Nhat Cuong Company”. In which, Dung was transferred to Mr. Chung 2 times, including 6 “Confidential” level documents.
Nguyen Hoang Trung and Nguyen Anh Ngoc (SN 1974, resident of Long Bien district, Hanoi city) – former deputy chief of the editorial secretariat are the two defendants who once helped Mr. Chung print and edit documents in the secret list. “Confidential” state level.
In this case, the accused Nguyen Duc Chung is the mastermind, Pham Quang Dung is the practitioner, Nguyen Hoang Trung and Nguyen Anh Ngoc are the helpers.
The four suspects mentioned above were charged with “appropriation of secret state documents” under article 337 of the Penal Code (Penal Code). The defendants Nguyen Duc Chung and Pham Quang Dung were formally charged within the framework of 10 to 15 years’ imprisonment under point C, clause 3, article 337 of the Penal Code. The defendants Nguyen Hoang Trung and Nguyen Anh Ngoc were prosecuted within the framework of 2-7 years in prison under Clause 1 of this law.
