But Mr. Nguyen Nhat Cam, Director, Chairman of the Procurement Advisory Council, chose the price of CDC Hanoi goods / services, did not comply with the above regulation.

After the agreement, Nhat and Dao The Vinh (Director of MST Company) and Tuyen agreed to increase the price of the Realtime PCR system from more than 3.7 billion to 7 billion.
The highly sophisticated price increase procedure concludes with the investigation: Orient Company imported the Realtime PCR System for more than 2.3 billion VND (including tax) and then sold this system to the company. Hung Long (run by Ms. Nguyen Hai Yen, Dao The Vinh’s wife) for more than 3.7 billion.
Vinh then asked Ms Bui Thi Hong Ha (Director of KĐ Company) to sign a contract to purchase the Realtime PCR system from Hung Long Company for more than 4.6 billion dong.
After that, KD Company signed a contract to sell Realtime PCR System to Vinh’s MST Company for more than 6.6 billion dong.
Ultimately, MST Company sold the Realtime PCR System to CDC Hanoi for VND 7 billion.
The subjects agreed to pay Nguyen Nhat Cam 15%; spent on Dao The Vinh 15% of the price of the old system. The remaining difference after deducting expenses, Nhat and Tuyen each benefit 50%.
On March 3, MST Company installed and delivered the Realtime PCR system automatically, and put it to use at CDC Hanoi at 70 Nguyen Chi Thanh.
CDC Hanoi transferred payment of more than 9.5 billion VND to MST Company (including cost of 1.2 billion VND automatic DNA / RNA extraction machine; 3 refrigerators of 1.34 billion VND VND).
According to the investigation’s conclusion, Nhan Thanh Company was to assess the price on February 25 and issue an appraisal certificate to CDC Hanoi on February 27 (rewrite the date of February 24).
The issuance of price appraisal certificates does not comply with the regulations, has no legal value, causes damage to the State.
Testimony of Mr. Nguyen Nhat Cam
According to the testimony of the former director of CDC Hanoi, he perceives that his work is incorrect, not in accordance with the provisions of the Tender Law, the Accounting Law, which causes damage to the State.
However, Mr. Cam did not admit that Nhat had argued with him about the package percentage deduction for CDC Hanoi, so there was insufficient evidence to prove it.
According to Nhat’s testimony, this defendant knew Mr. Cam around 2018. After the 2020 Lunar New Year, Mr. Cam called Nhat for advice on Qiagen’s automated real-time PCR system – Germany, CDC Quang Ninh using.
After that, the two parties agreed to sell the automated real-time PCR system to CDC Hanoi for 7 billion VND and it will cost Mr. Cam 15% of the profits.
In mid-March, CQĐT discovered that the package was wrong. The damage in the case is determined to be more than 5,400 million.
In addition to the package worth more than 9.5 billion VND above, the remaining 16 packages of equipment and consumables purchased worth more than 81 billion VND, CDC Hanoi paid the contractor more than 69 billion VND .
There are also 2 packages of design, document printing and dissemination of propaganda content for disease prevention and control worth more than 1.9 billion VND, CDC Hanoi has paid the contractor more than 1.3 billion VND. .
So far, violations of previous tender packages have not been clearly determined, CQĐT, the Ministry of Public Security, separates the documents for further clarification.
