On the afternoon of September 14, the Hanoi People’s Court officially ruled 29 defendants in connection with a clash between the police and villagers on the early morning of January 9, 2020 in Hoanh Village, Dong Tam Commune , My Duc district.
The Trial Panel (Panel) sentenced Le Dinh Cong and Le Dinh Chuc (two old sons of Le Dinh Kinh) to murder on charges that they “planned and directed the murder”.
With the same offense, the court declared Le Dinh Doanh (Le Dinh Kinh’s grandson) life imprisonment. The defendant Bui Viet Hieu received 16 years in prison, Nguyen Quoc Tien 13 years in prison and Nguyen Van Tuyen 12 years in prison.
The remaining 23 defendants received sentences ranging from 15 months in suspended prison to 6 years in prison, all on charges against service persons.
Regarding civil liability, in the courts the representatives of the victims’ next of kin request the defendants to pay compensation in accordance with the law. On that basis, the Panel obliged each defendant belonging to the lead group to compensate 116 million dong for the family of each victim and to bear the costs of raising the children of the 3 victims until they were 18 years old.
Mr. Le Dinh Cong and Mr. Le Dinh Chuc will appeal.
How is the case
After four days of trial for the “Murder” and “Against Service Persons” cases that occurred in Hoanh Village (Dong Tam Commune, My Duc District), the Hanoi City People’s Court sentenced him in the afternoon. September 14.
According to the initial indictment, out of 29 people in Dong Tam Village, 25 were prosecuted for “murder” under article 123 of the Penal Code; four were indicted on charges of “executor of the public service” under article 330 of the Penal Code.
However, after the indictment, the representative of the city of Hanoi VKSND decided to change the indictment charges with 19 accused of “murder” to “executor of public service”.
Consequently, the VKSND proposed the death penalty for Mr. Le Dinh Cong and Le Dinh Chuc (son of Mr. Le Dinh Kinh).
Bui Viet Hieu and Nguyen Quoc Tien received a sentence of 16 to 18 years in prison; Nguyen Van Tuyen 14-16 years in prison for murder.
For the remaining 23 defendants, the VKS proposed a sentence of 15 months in prison suspended to 7 years in prison for the crime against executor of the public service.
In the final words, nearly 20 defendants said the same thing when they requested a leniency sentence, thanking the detention center supervisor for helping to recognize the mistake.
The land dispute in the Senh field, Dong Tam commune began to heat up in 2017, when Hanoi police arrested some Dong Tam residents after allowing the commune to ‘invite’ them to a meeting, in which Mr. Dinh Kinh, the leader of the village’s struggle to conserve the land, reported that the government forced him to break his leg.
The climax of the conflict came in April 2017, when Dong Tam villagers arrested more than 30 policemen to demand the return of the authorities. The incident prompted Mr. Nguyen Duc Chung, Chairman of the Hanoi City People’s Committee, to go directly to Dong Tam to talk to people.
During the meeting, Mr. Chung handed handwritten documents to Dong Tam people, of which he promised three things, including not to process them.
However, just two months later, the Hanoi city police decided to prosecute a criminal case related to the clash between the Dong Tam people and officials due to land disputes, in the direction of clarifying. two offenses of “illegally arresting or detaining persons” and “destroying property or intentionally damaging property.”
In late 2019, the Air Defense – Air Force, the Defense Ministry allowed people to dig trenches, build fences around Mieu Mon Airport, a disputed area, and faced opposition from the people of Dong Tam.
On the morning of September 1, 2020, the Hanoi Police dispatched thousands of troops to Hoanh Village, Dong Tam, Hoai Duc, Hanoi, which Mr. Luong Tam Quang, the Vice Minister, later told to enter for ‘ guarantee the security’. security and order for the construction of the Mieu Mon airport fence ”. The clash with the Hoanh villagers broke out, killing four people, including Mr. Le Dinh Kinh and three policemen. 29 villagers were arrested and detained. in which many people were seriously injured.
The conclusion of the investigation later said that the three policemen who fell into the hole were later burned by two Mr. Cong and Chuc poured gasoline on them.
However, the 29 legal aid attorneys charged said it is necessary to reconstruct the scene of the police death because the conclusion of the investigation has many conflicting details and a lack of evidence.
The attorneys also proposed returning the file to the investigating agency to consider and supplement the deficiencies.
