On the afternoon of November 13, the National Assembly approved the Law that modifies and complements several articles of the Law for the Management of Administrative Offenses. This Law comes into force as of 1-1-2022.
In particular, the National Assembly did not agree to include additional regulations on coercive measures to sanction administrative violations by cutting off electricity and water in the bill (article 86, bill).
The results of the vote approve the Law that modifies and complements several articles of the Law on the treatment of administrative offenses.
In the report on the explanation of the bill, the chairman of the National Assembly Law Committee, Hoang Thanh Tung, said about the addition of coercive measures to enforce the decision on the sanction of administrative offenses. Clause 2, Article 86 of the Law for the Management of Administrative Offenses), there are still many different opinions from the deputies of the National Assembly.
The first type of opinion proposes to receive comments from many deputies of the National Assembly, without adding the measure of “stop providing electricity and water services …”.
The second type of opinion considers that the incorporation of this coercive measure is necessary, complying with the practical requirements to force people, organizations that have been sanctioned for administrative infractions, to stop the infraction.
In this regard, due to the different opinions of the deputies of the National Assembly during the discussion, the Permanent Commission of the National Assembly (Permanent Commission of the National Assembly) has sent a vote to request the deputies of the National Assembly. The results of the opinion consultations showed that 207/399/481 deputies of the National Assembly proposed not to add this coercive measure.
190/399/481 delegates approved plan 2 to supplement this content. Because the number of deputies of the National Assembly who support each plan is not large, and at the same time does not exceed 50% of the total number of deputies of the National Assembly, the Standing Committee of the National Assembly requests to present both options as is shown in Clause 43, Article 1 of the project. draft the Law for the consideration and decision of the National Assembly.
“Most of the opinions in the Permanent Commission of the National Assembly coincide with plan 1, which accepts the majority of the opinions of the deputies of the National Assembly to respond to the votes, not to add coercive measures” to stop providing electricity and water services. “Because the review of the implementation of the law shows that there are basically no difficulties and problems due to the lack of measures to enforce the decision to sanction administrative offenses” – said Mr. Tung.
Consequently, on the afternoon of November 13, before voting to approve the entire bill, the National Assembly voted not to add the measure to “stop providing electricity and water services.”
As a result, 390 participants agreed (representing 80.91% of the total number of deputies to the National Assembly) not to add the measure of “stopping the provision of electricity and water services.”
(PL) – There is a current of opinion that electricity and water should be cut off in the violated works to reduce the damage to society; Another current of opinion is that cutting is the lack of humanity, difficult to persuade.
