On September 10, the Inspector of the Bac Giang Province Information and Communications Department worked with Nguyen Van Hung (Hung Vlog, son of Ms. Tan Vlog) to clarify the incident on his YouTube account, there was a video of cook porridge with chicken. whole feathers.

7.5 million fines

After the meeting, Mr. Le Hong Viet, Chief Inspector of the Provincial Information and Communications Department, signed a decision to sanction an administrative offense against Nguyen Van Hung with 7.5 million VND. The remedy is to force Hung to delete the infringing information posted on Hung’s YouTube video clip Vlog “Troll’s sister and brother eat a pot of chicken porridge and finish.”

According to the sanction decision, Hung committed the infraction: Providing and sharing information promoting customs, superstition, superstition, lewd, depraved, incompatible with the traditional customs of the people. (published on the YouTube Hung Vlog social network account) under Point b, Clause 1, Article 101 of Government Decree 15/2020. This Decree provides sanctions for administrative infractions in the fields of postal and telecommunications, radio frequency, information technology and electronic transactions.

Before that, Hung posted a video of cooking an entire pot of white porridge with a featherless chicken to poke fun at his two brothers around the house. The video faced many objections from the online community, so Hung removed the video on her YouTube channel.

In the video, Hung said: “Since there are so many chickens in the family, today I will force the whole child to put it in a pot to cook porridge for troll (joke – PV) his brother and sister. It was fun to think of the scene where the two of them ate a pot of oatmeal. “

After the brothers ate porridge and found the chicken in the pot, they found that the chicken still had the feathers, so the sister spat the porridge into her mouth. Below is the scene of the three brothers chasing each other.

Is there a violation of good customs?

The decision of the competent authority is like this, but many opinions consider that it is not appropriate for the authorities to issue a sanctioning administrative decision in this case with the above grounds.

According to Dr. Cao Vu Minh, a professor at Ho Chi Minh City University of Law, the punishment for Hung Vlog’s behavior is enforced. The video is published in the network environment so it is regulated by Government Decree 15/2020.

About Hung Vlog

Hung Vlog’s real name is Nguyen Van Hung (born 1992), he is known as quite a famous YouTuber. Currently, he has three YouTube channels including Hung Vlog, Hung Troll, and Hung Gamer, including many trolls (pranks) in his family.

He is the creator of the YouTube channel for his mother, Mrs. Tan Vlog (real name is Nguyen Thi Tan). Simplicity, humor and honesty are the main attraction in the clips of both Ms. Tan and her son. In addition to filming and editing clips for his mother, Hung Vlog also came up with the idea and appeared in his mother’s clips as a dough who specializes in eating giant plates that she cooked.

However, chicken is not a pet or rare animal, so it cannot be considered a violation of good customs and customs. It’s as if the person who made the clay roasted chicken also left the feathers in the process. On social media, people often show off the act of putting coconut weevils in fish sauce and eating them raw, an image that cannot be used to evaluate pure customs.

Granted, attorney Nguyen Huu The Trach of the Ho Chi Minh City Bar Association also said that while Hung Vlog’s behavior is offensive, spreading the video can create a tendency to mimic (perhaps, but that goes to imitate such an unhealthy kitchen). However, seeing the cuisine as shown in the video is incompatible with the good traditions and customs of the nation is not convincing.

MSc Nguyen Nhat Khanh, professor at Ho Chi Minh City University of Law, analyzed pure fine and fine customs as good and healthy customs, and all social norms must have been formed over time, from the style life of human. The act of providing or sharing information is incompatible with good customs and traditions, which destroys the good customs of the community, the nation and damages the spiritual life of the people.

In some countries, there are animals that are considered pets, cultural and spiritual symbols and beliefs in community life, such as cows in India and pandas in China. People here cannot harm or euthanize these animals, then take photos, post videos to share on social media.

“In Vietnam, the chicken is considered a bird, a food, not a pet. Chicken has no meaning in terms of spirituality and belief, so cooking Hung Chicken Porridge with the feathers intact should not be considered contrary to pure and fine customs, ”said MSc Khanh.

Managing dissent on social media is not easy

On the staff of Ms Tan’s son Vlog, there is a video of cooking chicken with its feathers, many people wonder about the standards and regulations governing offensive content on social media platforms. So far, this remains a difficult problem.

The features of many popular social networks are easy to use, fast to spread, and difficult to stop right away. The more intimate, fun, unique, bizarre, curious, or entertaining the content, the more views, comments, and interactions from popular people it will attract. Among the billions of videos on social media, there are a few forms that often attract viewers.

The first is the set of acts of violence, death, violation of good customs or the law. Early last year, the public was shocked when terrorists at two mosques in the center and suburbs of Christchurch, New Zealand, used Twitter and Facebook to report on the gruesome process of the crime. The persecution left 49 dead and 20 wounded. Blocking these videos in the first place is still a problem for the big guys like Facebook or YouTube, while countries still have a hard time knowing how to behave.

The second is the controversial group of videos, for example the video of cooking the chicken with its feathers on. Someone said it was a horrible, offensive and unconventional act; But some people think the chicken is dead, so it’s just a joke after all. Disapproval will now become a relative concept. Meanwhile, the social network review may or may not be removed.

Operators have continuously tried to implement and adjust their content production policies so that users avoid receiving negative and offensive videos. However, this is a difficult problem because: (i) Tight control affects the freedom of users, thus wasting the profits of the network operator; (ii) Sometimes it is difficult to agree on the dislike (like cooking chicken with the feathers); and (iii) Laws in other countries are also incomplete, making coordination with carriers difficult. YouTube pioneered the opening of a children’s YouTube channel for children. However, (iv) family management is also a difficult problem. By solving these problems, the history of negative impacts from social media will be minimized.
