Xi Jinping signed the aforementioned decree during the session of the Standing Committee of the National People’s Congress (that is, the parliament) of China after it passed the Customs Law, according to the China Global Television Network (CGTN). The new law will come into force on 1.2.2021.

According to the draft first published on January 4, 2020, the Chinese Coast Guard has the right to use force to repel foreign ships from entering the so-called Chinese territorial sea or to interrogate the crew. The draft also allows the use of weapons against ships that do not comply with the regulations on territorial sea, exclusive economic zone and continental shelf.

After the draft was announced, Indonesian Foreign Minister Retno Marsudi on November 10, 2020, expressed concern about China’s intention to allow the Coast Guard to use weapons to fight foreign ships in sovereign waters of Beijing. Meanwhile, Retno said it would stay in contact with China on the matter, according to NHK.
