However, the Department of Natural Resources and Environment introduced the content “form of land use: land lease with annual rent payment”. On October 14, 2020, the Ho Chi Minh City People’s Committee issued Decision No. 3845 / QD-UBND for the company to lease land with the land use form that pays annual land rent.

According to Ms. Tham, this decision is like a “final blow” for An Ha Company. Because if the annual rent for the land is paid, the company cannot take the project to mortgage the bank to obtain capital to build and complete the factory. An Ha Company consecutively sent letters to the Department of Natural Resources and Environment and the People’s Committee of Ho Chi Minh City requesting to adjust the form of land use, which is to rent the land with a one-time rental payment for the entire period. lease.

However, the Popular Committee of the City transferred the request to the Department of Natural Resources and Environment. Ms. Tham also met many times with DONRE to point out the provisions of the land law that allow the company’s project to lease land with one-time payment, but the representative of DONRE said that “the law says so but the Popular Committee of The City. In response to Ms. Tham’s opinion, Mr. Dinh Minh Hiep, Director of the Department of Agriculture and Rural Development, asked the representative of the Department of Natural Resources and Environment to respond.
