It can be seen that with such detailed information, most of the provisions of Decree 117 are read immediately and understood to be properly implemented. In particular, the next two provisions of Article 30 are causing more or less confusion, so it is necessary to clarify them. That is, inciting, provoking, inciting others to drink alcohol, a fine of 500,000 VND to 1 million VND (point b, clause 2); Forcing others to drink alcohol or beer will be punishable by a fine of 1 million to 3 million VND (point b, clause 3).

Choose something easier than “force” to say first. Forcing means doing something you don’t want to. Whatever it is, it is not good to force others to do it involuntarily. In the case of alcohol, beer can cause intoxication, loss of control of behavior … so it is even more forbidden to force others to drink.

Since then, Decree 117 stipulates the level of sanctions to minimize and eliminate the act of “forcing others to drink alcohol” appears to be necessary and reasonable.

In the case of food alcoholic beverages, production, marketing and use activities can still be carried out normally in accordance with regulatory requirements to maintain benefits (if applicable), minimizing harm (if used incorrectly, it is inappropriate). That is why our country has a Law for the Prevention and Control of Harms of Alcohol and Beer, not a law for the prevention and combat of alcohol and beer.

Therefore, the act of “inciting, provoking, inducing others to drink alcohol or beer” when it is not specifically regulated to point out the violation of drinking that alcohol, everyone should understand the majority, exactly? Someone thinks it is the act of requesting, challenging each other to drink wine and beer, but what is the basis for answering that, especially the words “drag”, “challenge” that do not have a negative meaning?

If the person who drinks alcohol, beer and immediately before is the person who energizes the drink or beer without any consequence, how to identify the behavior of “induce, manipulate” is necessary. Punishment, not an act of soliciting, persuading “drinking for fun” or at ceremonies, parties, gatherings?

After all, alcohol and beer are not to blame, it is the drinker who is to blame if they do not know how to behave and act correctly before, during or after drinking. The Law on Prevention and Control of Damages by Alcohol and Beer and Decree 117/2020 (which sanctions administrative infractions in the health sector) have quickly issued many regulations to help change the behavior of alcohol drinkers . . Therefore, for the above damage prevention and control measures to be implemented effectively, what must be continued is that the regulations on violations must be very clear, as quantitatively as possible. all understand correctly and together they obey and execute correctly. Regulations that make definition difficult, such as “inciting, tempting others to drink wine and beer,” should be adjusted to avoid puzzles and ensure feasibility.
