On January 18, the Hanoi People’s Court reopened the trial of first instance for the loss of 2,713 million of the case in the Ministry of Industry and Commerce and the Saigon Beer – Alcohol – Beverage Corporation (Sabeco).

In the proceedings, the defendant Vu Huy Hoang – former Minister of Industry and Commerce presented: “Due to poor health, being treated but strictly following the regulations with the defendant, I tried to attend the trial. For my health, during the rehearsal, I would like to sit down, take medicine and if I have a personal need, come out ”.

The president announced that the defendant Nguyen Huu Tin was seriously ill and unable to move and had a request for evidence in absentia. In addition, several people with other related obligations were absent. The president further reported that Judge Chu Phuong Ngoc assigned to hear this case was ill, so Mr. Vu Quang Huy – Alternate Judge will replace Ms. Ngoc’s role.

In court, the Minister of Industry and Commerce authorized 3 lower-level staff members to appear in court, including one who is the Deputy Director of the Legal Department. The HCMC People’s Committee also authorized 3 people to attend court.

Other related persons present include Mr. Thai Bao Anh – President of Me Linh Square Company; Ms. Pham Thi Hong Hanh – former CEO of Sabeco; Mr. Bui Cao Nhat Quan appointed an authorized representative …

Regarding the procedures, the representative of the KSND Institute agreed to replace the judge, but proposed to continue postponing the trial in the absence of the accused Nguyen Huu Tin, the expert from the Ministry of Natural Resources and Environment, some lawyers … He also proposed postpone the trial.

The case has 10 defendants in court, in which, Mr. Vu Huy Hoang (SN 1953), former Minister of Industry and Commerce; Phan Chi Dung (SN 1957) – The former director of the Light Industry Department was indicted for “Violation of the rules on the management and use of state property causes loss and waste.”

Eight other people were charged with “violating land management regulations”, including Mr. Nguyen Huu Tin (SN 1957), former vice chairman of the Ho Chi Minh City People’s Committee; Lam Nguyen Khoi (SN 1955) – Former Deputy Director of the Planning and Investment Department of HCMC; Dao Anh Kiet (SN 1957) – Former Deputy Director of the Department of Natural Resources and Environment of Ho Chi Minh City; Le Van Thanh (SN 1962) – Former deputy head of the Ho Chi Minh City People’s Committee office; Le Quang Minh (SN 1957): former director of the Planning and Investment Department of Ho Chi Minh City; Nguyen Thanh Chuong (SN 1974) – Former Head of the Urban Department of the HCMC People’s Committee; Truong Van Ut (SN 1970) – former deputy director of the Department of Natural Resources and Environment of Ho Chi Minh City; Nguyen Lan Chau (SN 1975) – Former expert of the Department of Natural Resources and Environment of Ho Chi Minh City.

According to the indictment, Sabeco established a SABECO Pearl joint venture to construct an office building project at 2-4-6 Hai Ba Trung (HCMC). In which Sabeco owns 26% of the capital; the rest belong to private companies such as Attland (23%), Ha An (25.5%), Me Linh (25.5%).

Mr. Vu Huy Hoang and his subordinates at the Ministry of Industry and Commerce agreed to this and the Ho Chi Minh City People’s Committee approved the construction on the site. However, by 2016, the private companies asked Sabeco to divest from the joint venture and it was approved by Sabeco and the Ministry of Industry and Commerce. Thus, state-owned land number 2-4-6 was acquired at low cost by private companies, which caused a loss of VND 2.713 billion.
