The Government abolished the regulations on the licensing of musical and theatrical works composed before 1975 in the south and Vietnamese compositions abroad.

Consequently, on December 14, the Government issued a new decree on performing arts activities, stipulating that the units and individuals that organize artistic performances must have the written approval of the management agencies. The Ministry of Culture, Sports and Tourism authorized the performing arts within the framework of international cooperation at the Central. The Provincial People’s Committee authorized the event in the area.
Organizations and individuals send dossiers to management agencies 7 days before the artistic event. Granting authority to hold the event within 5 days after receipt of the registration; In case of not obtaining the license, the reason must be clearly stated.
The Decree describes the prohibitions on performing arts activities, which include: Anti-state; distorting history; violate national security; denial of revolutionary achievements; insulting leaders, national heroes, celebrities …
Furthermore, programs and works of art must not incite violence, propagate wars of aggression, cause hatred between nations or adversely affect foreign relations. Costumes, words, sounds, images, movements and behaviors must not be contrary to good national traditions, nor should they adversely affect morals, public health and social psychology.
In accordance with previous regulations, the licensing of performing arts was divided into two groups with works composed before 1975 or by Vietnamese living and settled abroad and works after 1975.
For works composed after 1975, the popularization of the license will not be necessary, only the license to perform according to each specific program. However, works composed before 1975 and by Vietnamese abroad must be licensed to be broadcast and then included in artistic performances. Thus, the new decree has eliminated the regulations on the granting of licenses for the popularization of musical and theatrical works.
Mr. Tran Huong Duong explained that licensing to broadcast musical and theater works is “to create the best conditions for performing arts activities to develop and create creative spaces for artists.” He also hopes that these new regulations will help the public to fully enjoy good, meaningful and healthy works.
“With the new rules, we will go mainly from pre-verification (pre-event registration) to post-verification (post-verification). Performing arts activities. Of course, units and individuals who violate these prohibitions will be treated strictly,” he stated Mr. Duong.
Previously, in February 2019, the Government approved the reform policy of two decrees 79 and 15 on the performing arts. At the time, the Ministry of Culture, Sports and Tourism proposed to withdraw the license of the song before 1975, because it was thought to be the author’s personal property and mostly had healthy content. The management agencies only intervene and prevent “works of reactionary content that go against the State and defame organizations and individuals.”
The controversy over whether to keep the song’s license before 1975 occurred in March 2017, when the Department of Performing Arts suddenly requested to stop the circulation of 5 songs before 1975 for reasons that are not clear. Faced with the harsh reaction of public opinion, the Department had to withdraw its decision. But then, public opinion was shocked because Joining the great arms of musician Trinh Cong Son, despite being sung everywhere for more than 50 years, is still not licensed.
In May 2017, the Ministry of Culture, Sports and Tourism requested the Department of Performing Arts to follow the instructions of Deputy Prime Minister Vu Duc Dam, to stop licensing the song if the content is not contrary to good customs and traditions. violating national interests. At the beginning of 2018, for the first time, the Ministry of Culture published a preliminary draft of a dossier requesting the formulation of a decree on performing arts, in which it proposed to withdraw the license of songs before 1975, and also made a list of prohibited songs if they go against national interests.
