The Ho Chi Minh City Police Department, the CSDT, has just released the findings of a further investigation, proposing to prosecute Nguyen Minh Tan on charges of disorderly conduct.
Before that, on November 17, Tan was arrested and detained again, currently in the Chi Hoa Detention Center.
Tan was the last person to be investigated in a murder and public disorder case that occurred 26 years ago.
At the end of November 11, 1994, in Dien Bien Phu Street, 15th District, Binh Thanh District, there was a fight between many people with a knife and a horse, which killed one person and injured another.
Tan was 36 at the time, cycling and also the captain of the civil defense team of Room 2, District 15, Binh Thanh District, escaped and changed his name.
The high-level People’s Court in Ho Chi Minh City twice judged the appeal ruling that Tan’s behavior showed signs of murder.
In October 1995, the Ho Chi Minh City People’s Court tried in the first instance and sentenced the participants on charges of disorderly conduct. For Tan, the court said: “The death of the victim is caused by Tan and some young men who have escaped, and they will be handled later when they are caught.”
One day in August 2014, the victim’s sister, Ms. Nguyen Thi Tuyet Linh, discovered Vo minh hung (Deputy Street Protection Department in Binh Hung Hoa A Ward, Binh Tan District, Ho Chi Minh City) is being praised, receiving flowers and certificates of merit for his achievements in the program’s capture and theft. However, when he was arrested, Tan confessed that he only held civil defense sticks to fight, but did not hit anyone.
The Ho Chi Minh City People’s Court twice sentenced the first instance to convict Tan for disturbing public order with the first sentence of 1 year and 6 months in prison, the second of 5 years in prison. Both sentences were later canceled by the appeals court with the ruling that Tan showed signs of murder.
Tan was arrested in the first instance, for which he was released. In March 2020, CQĐT imported the disorderly conduct case in the murder case.
However, on December 7, 2020, CQĐT separated the case and temporarily suspended the investigation of the murder case due to the existing evidence and insufficient grounds to prosecute Tan guilty of murder.
Ms. Nguyen Thi Tuyet Linh said that her family will continue to complain to demand the handling of Tan guilty of murder.
