The four defendants in this case are: Nguyen Duc Chung (born 1967, former chairman of the Hanoi People’s Committee); Pham Quang Dung (born 1983, former Police Department officer investigating corruption, economy, smuggling, Ministry of Public Security); Nguyen Hoang Trung (born 1983, former Hanoi Police Officer, attached to the Secretariat – Editorial Office, Hanoi People’s Committee Office); Nguyen Anh Ngoc (born 1974, former Deputy Chief of Police in Cau Giay District, Hanoi, assigned to work and held the position of Deputy Chief of the Secretariat – Editorial Office, Hanoi People’s Committee Office).
These defendants were prosecuted by the Supreme People’s Prosecutor’s Office on charges of “appropriation of secret State documents” under article 337 of the 2015 Penal Code.
In particular, the defendants Nguyen Duc Chung and Pham Quang Dung were prosecuted under clause 3 (sentence framework of 10 to 15 years in prison). The other two defendants were charged in paragraph 1 (sentence of 2 to 7 years in prison).
The judgment panel consists of three people: a judge, two members of the jury. Two prosecutors from the Hanoi People’s Prosecutor’s Office have the right to prosecute at trial. There are 7 lawyers involved in the defense of the accused.
According to the indictment, Mr. Nguyen Duc Chung and his wife, Nguyen Thi Truc Chi Hoa, are individuals with rights and obligations related to the Nhat Cuong Company case. This case belongs to the Central Steering Committee for the fight against corruption to supervise and direct.
To learn the information and documents of the Nhat Cuong case, the defendant Nguyen Duc Chung contacted and asked Pham Quang Dung to provide information and documents about the case.
During the period 7/2019 to 6/2020, following the request of the defendant Nguyen Duc Chung, the defendant Pham Quang Dung has appropriated 5 times 9 documents from the list of “confidential” state secrets, related to to the case of the Nhat Cuong company.
In which, the defendant Dung transferred the defendant Chung twice, including 6 documents in the list of state secrets with “confidential” level.
For 2 defendants Nguyen Hoang Trung and Nguyen Anh Ngoc, the prosecution found that he once participated in the printing and editing of three “confidential” documents of the defendant Nguyen Duc Chung.
The Supreme People’s Prosecutor’s Office determined that, in this case, the defendant Nguyen Duc Chung is the mastermind, Dung practiced, the two remaining defendants Trung and Ngoc helped.
