Immediately afterwards, the representative of the Government Inspectorate reported on the preliminary results of the inspection and review related to the complaints. First of all, with regard to the complaint about planning limits, households do not agree with the conclusion of the Government Inspector in the notice of conclusion of inspection No. 1483 dated 4 of 9 of 2018, whose content is not only 4.3 ha. located outside the planning limit, but people think that the 5 neighborhoods in 3 districts are outside the limit.

Regarding the test results, the Ho Chi Minh City People’s Committee provided the working group with several maps, kept by Mr. Vo Viet Thanh, former Chairman of the Ho Chi Minh City People’s Committee, on planning the new urban area of ​​Thu Thiem. Mr. Thanh said that it is a map with the documents presented to the Prime Minister for the signing of Decision 367/1996, which he reported to the Prime Minister during the period as Vice Chairman of the Ho Chi Minh City People’s Committee. These maps are stamped by agencies including: Office of the Chief Architect, Department of Construction, Urban Development Services Company HCMC.
When comparing the saved Mr. Thanh map with the 2 maps provided by the Ho Chi Minh City People’s Committee, it matches the planning boundaries. From there, we can confirm the definition of the limit in the conclusion notice 1483/2018, in which it is determined that the area of ​​4.3 ha outside the planned limit is in accordance with the regulations and reality.

In addition, compared with the regulations on the planning system of drawing symbols and construction drawings in the relevant period, the Government Inspection declares that the planning agencies do not sign or seal the drawings. The planning carried out before 7.7.2005 is in accordance with the regulations.

On March 18, 1997, the Ho Chi Minh City People’s Committee decided to establish District 2 with an area of ​​5,020 hectares with 86,027 inhabitants, including 11 districts, the boundaries of district 2 were identified on the district map and marked on the field.

In 1998, the Popular Committee of District 2 issued the decision to establish neighborhoods, residential groups, hamlets and popular groups, on that basis the location and boundaries of 5 neighborhoods belonging to the 3 districts that people complained about were determined.

After comparing with the map of the plot number of the people with the boundary of the new urban area of ​​Thu Thiem, the Government Inspector said that the boundary position of the houses and land of the complainant households is at the boundary of the New Urban Zone of Thu Thiem. .

Furthermore, the area provided for in Decision 255/1998 is about 590 hectares, which is approximately 630 hectares smaller than the area provided for in Decision 367/1996. The Government Inspectorate said that the aforementioned actions of the Ho Chi Minh City People’s Committee are not in accordance with Decree 91, so they will propose to the Government to lead the HCMC People’s Committee to handle and rectify.

According to Decree 91, Decision 255/1998 of the People’s Committee of Ho Chi Minh City is not the basis for defining the limit of land acquisition planning and land allocation for the new urban area of ​​Thu Thiem.

“The fact that people rely on the inadequate work of Ho Chi Minh City in regional planning does not sell state-owned houses in Decision 255/1998 to complain about the planning limit of the new urban area of ​​Thu Thiem basis for consideration and settlement, ”said the representative of the Government Inspectorate.

The Government Inspectorate also said that Ho Chi Minh City Chief Architect’s Decision 13585/1998 on Detailed Planning 1/2000 Thu Thiem New Urban Area had errors in location and function compared to map and reality. practice. The aforementioned improper and irresponsible works were concluded in the Notice of the Government Inspector 1483/2018.

Finally, the representative of the Government Inspection concludes that there are sufficient bases to determine the location, the limit, the number of land that people complain about within the limit of the New Urban Zone of Thu Thiem. Therefore, people’s complaints have no basis to resolve.
