The package contract increased by 6.5 million euros

According to TTCP, the package contract on consulting services for the implementation of the project, immediately after its implementation, problems, deficiencies and unreasonable problems arise between the parties (Hanoi City Railway Management Board: MRB, Systra Consultants, Vietnamese authorities and other related units).

Specifically, in the content of the package contract there are shortcomings, shortcomings, a lot of unclear content, leading to a different understanding between the parties, in addition to understanding the meaning of the content between the Vietnamese version and the Vietnamese version. The brother of the parties also has certain differences.

In addition, this is the first complex and large-scale project to apply new technologies and foreign standards in Vietnam, but the contract only defines a period of 25 months, with a total value of 10.6 Million euros are unviable, difficult to fulfill and the requirements to implement this special project have not yet been fully anticipated.

Also according to TTCP, some adjustments increase the contract value, but do not increase tasks, but mainly because the process of implementation of Systra tasks is delayed, much compared to the progress of the package contract. Initially, Systra must mobilize staff and costs over a long period of time, which translates into higher costs.

Through a review of the reasons, the increase in the price of the consulting contract (package contract) includes the costs outside the scope of the functions, the cost of cases of force majeure as prescribed and the expenses. charge within the mission.

However, when preparing, evaluating and approving estimates of additional adjustments, the investor and the authorities did not specify these costs. On the other hand, during the process of negotiating the adjustment of the consulting contract, the investor did not clarify the responsibility of Systra Consultants in delaying the determination of costs and deductions when preparing estimates of additional costs.

Responsibility belongs to the leadership of the Hanoi Urban Railway Board of Directors through the periods, units and collectives of MRB, the relevant persons; Department of Planning and Architecture, Planning and Investments.

No transparency

The TTCP said that the complaint of the selection of the contractor for package No. 1, the high stretch, shows signs of violation of the law is reasonable.

Specifically, the evaluation between Systra Consulting and the investor is not consistent, there is no transparency, it does not comply with the provisions of the bidding law, selection of contractors in accordance with the Bidding Law.

On October 18, 2013, the Hanoi Urban Railway Board of Directors met with the Ciencol-Lotte consortium. At the meeting, Ciencol-Lotte Joint Venture respected the results of the bid evaluation of Systra Consultant and the Hanoi Urban Railway Management Board of Directors. Result The contractor Dealim won the tender with a bid of 65.2 million euros.

The infractions in the tender were indicated by the Planning and Investments Department in Document 629 / BC-KHĐT of June 28, 2013: infraction of article 29 of the Law of Tenders No. 61/2005 and article 18 of Decree No. 85/2009 to guide the implementation of the Tender Law and select construction contractors under the Construction Law.

Similarly, the complaint of the selection of the contractor to implement package 3, the tunnel and the underground stations shows signs of violation of the law is reasonable.

Specifically, contractors JV and MRB signed a contract to build Package 3 when there was no clean ground and delivered it to the contractor for construction. The joint venture contractor proposes to add the cost to the contract price based on the “Preliminary Construction Plan” that has been developed at site delivery and certified deadlines.

However, at the time the inspection has not yet delivered the complete installations of the CP03 Package. Currently, the terrain of stations 9,10,11 is in line with planning, the site cannot be cleared, leaving no room to hand over to the contractor during this time.

The delay in the delivery of the site to the Contractor under the contract leads the Contractor to adjust the execution plan in accordance with the signed contract, for which the Contractor requested an additional budget for this around 40 million USD, the risk of damage to the state budget.

In the complaint, Binh said there are signs of repression and elimination of people who fight corruption and waste through cadre work.

Regarding this content, the TTCP said that before Mr. Binh filed a complaint, he had some reports of MRB’s errors to the secretary of the Hanoi Party Committee and the chairman of the Hanoi City People’s Committee. The Inspection Committee of the City Party Committee organized the monitoring, the chairman of the Hanoi People’s Committee assigned the Chief Inspector of Hanoi to establish an inspection team to consider it, but Mr. Binh did not agree and continued submitting the request to the authorities. The central authority denounced the violations by the Hanoi Urban Railway Board of Directors.

During his work as Deputy Director of the Hanoi Urban Railways Management Board, Mr. Binh was not disciplined and always completed his assigned tasks, the reason for not being re-elected was when the credit vote was taken. At the cadre and officials conference, Mr. Binh did not get the required number of votes.

However, the results of taking the vote of confidence of the Collective Party Committee and the leaders of the Hanoi Urban Railways Management Board, Mr. Binh obtained the votes. Therefore, the TTCP suggested to the Hanoi Party Committee to reconsider Mr. Binh’s working process, on the basis of which Mr. Binh’s interests are secured, so as not to allow the complaint to be prolonged.
