The Government promulgates Decree 135/2020 / ND-CP on the retirement age of employees.

Specifically, as of January 1, 2021, the retirement age of employees under normal working conditions will change:

The retirement age of the employee under normal working conditions is 60 years and 03 months for male employees, and 55 years and 04 months for female employees; Thereafter, each year a 3-month increase for male workers until they reach 62 years of age in 2028 and each year a 4-month increase for female workers each year until they reach 60 years of age in 2035.

The Decree also stipulates that the retirement age is lower than the employee’s normal retirement age by virtue of clause 3 of article 169 of the Labor Code.

Specifically, employees in the following cases may retire at an age less than but not older than 05 years than the retirement age at the time of retirement, unless the law provides otherwise. Specifically:

People who have completed 15 years or more performing heavy, dangerous or dangerous occupations or work or that are extremely heavy, dangerous or dangerous in the list promulgated by the Ministry of Labor, War Invalids and Social Affairs.

People who have 15 years of work or more in regions with extremely difficult socio-economic conditions, including working time in areas with the regional allocation coefficient of 0.7 or more before 1-1-2021 (extremely difficult socio-economic region).

The employee suffers a decrease in work capacity of 61% or more.

People who have a total working time of heavy, dangerous, dangerous or extremely heavy, dangerous or dangerous occupations or jobs, and who have worked in extremely difficult socioeconomic regions for 15 years or more.
