The Prime Minister has directed 5 times related to the case, but so far, the Ba Ria – Vung Tau People’s Committee has not implemented it.
Also at the request of the Permanent Deputy Prime Minister of the Government, the Ba Ria – Vung Tau People’s Committee must fully resolve the complaint of 15 households, informing the Prime Minister about the results of the implementation by November 30, 2020. The Ministry of Natural Resources and Environment has a specific instruction document that the Ba Ria – Vung Tau Province People’s Committee is responsible for solving the case of the complaint in accordance with the law.

The Vung Tau People’s Committee – Con Dao Special Zone assigned the P.11 People’s Committee to temporarily manage 40.9 hectares of pineapple planting land handed over by the Department of Agriculture and Forestry. For many years, Mr. Nguyen Van Tong (11th District, Vung Tau City, Ba Ria – Vung Tau), representing 15 households, filed complaints in many places. On April 21, 2005, Mr. General represented the group to request a certificate of rights to use agricultural land, certified by the President of the Popular Committee P.11 on November 9, 2005 with the content on the origin of the land use.

Specifically, the origin of land use clearly states: the home of Mr. Nguyen Van Tong, permanently residing in 36 Do Luong Ward 11, Vung Tau City, registered to use an area of ​​100,000 m2, sheet 44, parcel 96, 97, 98, 99, 100, 101, 102, 103, 104 located in Ward 11, originated by P. Phuoc Thang (ex) to the retirement team (the 15 households mentioned above, tax receipts represented by Mr. Do Van Lu on his behalf) paying taxes), now Mr. Nguyen Van General represents his name to apply for a Land Use Right Certificate (LURC) and has been using it continuously ever since without any dispute.

On June 11, 2008, the Vung Tau City People’s Committee responded in writing to Mr. Tong regarding the request for a LURC as follows: “Because Mr. Tong’s land area is at three recovery decisions by the province, the Popular Committee of the City does not consider issuing LURC for it to represent it. The pension organization will continue to be used according to the current state, pending the authorities recover the land, they will consider compensation and support in accordance with the law ”.

On August 4, 2008, the Vung Tau City People’s Committee issued Decision No. 3133 / QD-UBND to reclaim 5.4 hectares of land used by the P.11 Retirement Group to invest in the construction and business of various resorts. Multi-purpose and entertainment resort in Chi Linh, Cua Lap area.

The chairman of the Vung Tau City People’s Committee issued Decision No. 4342 on approval of funding for compensation and support for retiree groups. In this decision, the Vung Tau City People’s Committee only compensates and supports the amount of more than 90 million VND, including compensation for eucalyptus, cajeput and fish pond without compensation for land use rights.

For disagreeing with the above decision, 15 households have filed a complaint demanding compensation for the value of land use rights due to the land used before October 15, 1993. However, the Popular Committee of Vung Tau City and the Ba Ria – Vung Tau Province People’s Committee rejected the content of people’s complaints. Therefore, people continue to complain to the Prime Minister. The complaints lasted for many years.
