The Investigative Security Agency, the Ministry of Public Security, has just concluded the investigation into the seizure of secret state documents that occurred in Hanoi, proposing to prosecute it. Nguyen duc chung(Former Chairman of the Hanoi City People’s Committee) with 3 other people on the crime of appropriation of state secret documents.
According to the conclusion of the investigation, on May 14, 2019, CQĐT of the Ministry of Public Security processed and investigated the criminal case that occurred at Nhat Cuong Trading and Service Co., Ltd. (Nhat Cuong Company) and some related units. (the case of the Nhat Cuong company).

In which, CQĐT has determined that Mr. Nguyen Duc Chung and his wife, Nguyen Thi Truc Chi Hoa, are persons with related rights and obligations.
To gather information and documents on the investigation of the case, Mr. Chung approved Mr. Phan Huy Le (Chairman of the Board of Members, Managing Director of Ha Thanh Company Limited) to introduce and meet Mr. Pham Quang Dung, Officer of the Department of the CSDT in crimes of corruption, economy and smuggling – Ministry of Public Security (Economic Police Department), who is recruited to participate in the investigation of the case of the Nhat Cuong company.
On June 16, 2019, Mr. Nguyen Duc Chung raised the matter and it was then agreed to collect and provide information and documents on the status, progress and results of the investigation of the Nhat Cuong Company case.
In order for Mr. Chung to be provided with information and documents, Mr. Dung took advantage of the search to support the investigation of the case to obtain information and documents that he was allowed to access or break into the officer’s office. Soldiers from Division 14 of the Economic Police Department (the unit assigned to handle the case) stole documents and reports.
The result of the investigation determined that from July 2019 to June 2020, Mr. Dung repeatedly collected and appropriated documents related to the case of the Nhat Cuong company.
The secret key
Specifically, around 23:00 on June 4, Mr. Dung broke into the private office of Mr. Nguyen Van Thanh – Head of Division 14, Economic Police Department (at 47 Pham Van Dong), using his phone to steal 3 documents. on Mr. Thanh’s desk.
These documents include: Report on the results of data extraction and payment of contraband goods for 16 suppliers of the Nhat Cuong company; Documents to inform Vice Minister Nguyen Duy Ngoc on the progress, results and plans to conclude the investigation of the case at the Nhat Cuong company and Report on the results of the verification that the Nhat Cuong company provides public services to the city. Hanoi from 2017 to 2019.
In order to break into Mr. Thanh’s office, Mr. Dung previously stole the key to the office of the Chief of Division 14, Economic Police Department.
After collecting the documents, Mr. Dung repeatedly provided information and documents to Mr. Nguyen Duc Chung through three methods: using the Viber software application on mobile phones to exchange and provide information. or transfer photo files directly through Viber, or through an intermediary to provide paper documents to Mr. Nguyen Duc Chung.
The results of the investigation showed that, with sufficient grounds to determine, Mr. Dung transferred 12 documents from the Nhat Cuong Company case to Mr. Nguyen Duc Chung on three occasions. In which there are 6 documents in the list of state secrets at the “Confidential” level.
The investigation concludes that the behavior of Mr. Nguyen Duc Chung was committed with the crime of appropriation of secret State documents with the role of intellectual author and leader.
As of now, it is not possible to clarify the nature of the fact that Mr. Dung received 10,000 USD from Mr. Nguyen Duc Chung, so the Investigative Security Agency of the Ministry of Public Security separates the above behavior to consider it and handle it later.
According to CQĐT, there is no basis to determine that Mr. Phan Huy Le knew that Mr. Dung appropriated the case documents provided by Nhat Cuong Company to Mr. Nguyen Duc Chung. Therefore, there is no basis for considering and dealing with Mr. Le.

During the investigation, Mr. Nguyen Duc Chung admitted and clearly stated his criminal conduct. Also according to CQĐT, during his working time, Mr. Chung was rewarded many times for his outstanding performance at all levels. In particular, Mr. Nguyen Duc Chung received the title of Hero of the People’s Armed Forces of the doi moi era, with a history of cancer. CQĐT suggests that prosecuting agencies consider and apply circumstances to mitigate Mr. Nguyen Duc Chung’s criminal liability during the prosecution and adjudication process. |
