In August 2009, PVC signed a contract with PVC Kinh Bac for the construction of some items for the Dinh Vu – Hai Phong polyester factory project (contract No. 173, worth more than 132 billion VND).
According to the agreement, PVC will advance PVC Beijing according to the progress of work, the total advance value is 10%, equivalent to more than 13.2 billion VND.

During the implementation of the contract, Trinh Xuan Thanh spoke with Do Van Hong to purchase land to invest in the construction of a resort. They both surveyed and agreed to buy a 3,400 m2 piece of land in Tam Dao city.
In order to have money to buy the land, the two defendants agreed to instruct PVC to give PVC Beijing an advance of 25 billion dong, although previously PVC had advanced more than 10% of the amount stipulated in the contract.
Due to the above discussion, in June 2010, Do Van Hong signed an official letter to PVC, requesting to advance the above amount. On the PVC side, following the instructions of Trinh Xuan Thanh, the company transferred 25 billion VND from its account to Kinh Bac PVC.
After receiving the money, Do Van Hong used almost 24 billion VND to buy 3,400m2 of land in Tam Dao. By July 2020, the Vinh Phuc Province Department of Natural Resources and Environment issued a certificate of land use rights on the mentioned lands to Kinh Bac PVC.
To legalize the previous advance of 25 billion dong, Trinh Xuan Thanh and Do Van Hong agreed to increase the charter capital of PVC Kinh Bac from 50 billion to 150 billion. The defendants then converted this money into PVC shares in Beijing PVC.
In order to own 3,400 square meters of land, Trinh Xuan Thanh asked her biological father, Mr. Trinh Xuan Gioi, to establish Mai Phuong Investment Company Limited. Thanh asked Do Van Hong to transfer this land from Kinh Bac PVC to Mai Phuong Company for 23.8 billion VND.
However, taking advantage of the position of chairman of the PVC Board of Directors, influencing the operation of PVC Beijing, Trinh Xuan Thanh only paid 20.8 billion VND, the remaining 3 billion VND was not paid by the defendants. Until now, the PVC Kinh Bac ledger system still records the amount of VND 3 billion as a receivable from Mai Phuong company.
In August 2015, Mr. Trinh Xuan Gioi transferred the entire Mai Phuong company, including the 3,400-square-meter land, to Trinh Xuan Thanh’s wife, Tran Duong Nga.
Almost a year later, Ms. Nga continued to transfer all the assets of the Mai Phuong company to Mr. Kieu Dao Lam (who resides in Vinh Phuc) for VND 45 billion.
On December 24, 2016, the Security Department of the Ministry of Public Security issued a decision to temporarily confiscate the certificate of right to use land on 3,400 square meters of land under the name Mai Phuong Company.
The investigative agency determined the behavior of Trinh Xuan Thanh and Do Van Hong that caused more than 13.2 billion VND damage to PVC. In particular, the defendant Thanh benefited from 3 billion VND.
