At midmorning, there was no ruling protecting the separation of the Road Traffic Law into two laws, the Road Traffic Law (amended) and the Law on the Guarantee of Order and Traffic Safety.
Meanwhile, all the comments on this issue expressed their disagreement with the separation of the law.
Delegate Hoang Duc Thang (Quang Tri) said: “Most countries in the world enact traffic laws under different names, such as traffic safety law or traffic law, but they regulate the same elements as the current traffic law.”
He stated that ensuring road safety is a very important objective, the level of road safety depends on the elements of the road infrastructure, vehicles, drivers and traffic participants. What elements alone? If the law is separated for the two ministries to run the state, it will be overlapping and inappropriate.
“Other laws on railways, inland waterways, maritime and aviation also have a four-element regulatory structure, such as the traffic law, which is normative. Separating the traffic law will alter the nature. Logic, synchronization in the legal system.” expressed Mr. Thang.
For a more detailed analysis, Delegate Thang said that in case the Road Traffic Law was divided into two laws, the name of the Road Traffic Law had to be changed to correct the meaning because there were only two elements left, namely , traffic infrastructure and means of transport. information, which must be established as the Infrastructure and Transportation Law.
According to the deputy director of the Legal Committee Tran Thi Dung, in the law-making program, the ordinance in 2020 has only the name of Road Traffic Law (amended), there is no name of the Road Safety Law. the National Assembly has not been clearly informed and the assessment of the impact of the law is inadequate.
“I agree with Delegate Hoang Duc Thang’s analysis and propose to leave, carefully evaluate, for the XV National Assembly to consider this bill,” said Ms. Dung.
Consistent with previous views, delegate Cao Van Trong (Ben Tre) also said that “splitting into two is not very appropriate.” According to him, reading the two bills shows that there are repeated contents. Therefore, he proposed to modify and complement the current Highway Traffic Law to ensure the coherence of the law.
“The highway is related to other types of roads, especially railways, aeronautics …, so if they separate, there will be deficiencies in management, increasing administrative procedures,” said delegate Trong.
Observing the process of government agencies to develop bills, Law Committee permanent member Bui Van Xuyen (Thai Binh) said that the government introduced this bill in a rather urgent situation. Mr. Xuyen stated: “I also propose to leave this law to the XV National Assembly to make it more formal. I am not saying that I agree to transfer the management of the evidence to the Ministry of Public Security or not, but I propose not to separate the law.” .
Delegate Xuyen reiterated Delegate Thang’s analysis that the law has four elements, which will be highly inappropriate in management.

Obviously, delegate Pham Van Hoa (Dong Thap) “does not agree to separate the law, transferring the authority to administer, train and test driving to the Ministry of Public Security is inappropriate.”
MPs Nguyen Van Son (Ha Tinh) said that the argument to switch to the police station that manages the test and training to combat the falsification of certificates and papers is not convincing.
