On the morning of November 6, a higher court in Ho Chi Minh City held an appeal trial against the defendant Tran Ngoc Phuc (Phuc XO himself) and his accomplices on charges of harboring drug use and illegal possession of narcotics. and do not report the criminals.
In the appeals court, Phuc XO could not go alone, but had to have the support of others. According to a police officer, Phuc began to show signs of muscle atrophy from the first instance trial.
According to the content of the first instance judgment: At 1:30 am on April 10, 2019, the authorities searched the XO Pharaon karaoke bar, they discovered that Phuc and his accomplices rented a place for many people to sing karaoke and consume drugs . The test results showed that 19 guests in the karaoke rooms were positive for drugs.
Continuing with the search for Phuc’s whereabouts, the police discovered and confiscated from Tai (Phuc’s younger brother) 20 blue tablets, 12 plastic bags with white powder (through drug evaluation), 5 plastic tubes, several phones, 4 metal swords, tear gas cans, sports pistols, and lots of unused bullets …
Nguyen Van Sang (a restaurant employee) knows and has directly seen karaoke rooms on the second floor for guests to enter karaoke and do drugs. Although Sang has not served drug rooms, he has not reported the crimes of Phuc and his accomplices.
Through a search, the authorities discovered that Tran Ngoc Tai, Dang Trung Nghia, Tran Thi Quynh, Nguyen Thi Mong Dang (all store personnel) had illegally stored narcotics for the purpose of using them.
Since then, the trial panel said that there are sufficient grounds to conclude that defendants Tran Ngoc Phuc, Nguyen Phuoc Thinh, Do Van Gioi, Nguyen Thanh Xuan, Cao Van Thinh, Do Quoc Thinh, Dinh Van Duc, Le Van Duong Em Pham harboring the illegal use of narcotics.
The defendants Tran Ngoc Tai (Phuc XO’s younger brother), Dang Trung Nghia, Tran Thi Quynh, Nguyen Thi Mong are committing illegal possession of narcotics. The defendant Nguyen Van Sang committed a crime by not reporting a crime.
In the case, Phuc is the manager of a karaoke bar, with the highest role. The defendants Gioi and Thinh took the guests to the rooms, provided tools for the use of drugs to the guests, so they had a more important role than the other employees. Xuan is in charge of registering the symbols of drug users on the banknotes, so he has a role equal to that of Thinh and Gioi.
On June 17, the Ho Chi Minh City People’s Court sanctioned the defendants as follows:
Criminal group that harbors the illegal use of narcotics: Tran Ngoc Phuc: 12 years in prison, an additional fine of VND 50 million, forcing Phuc to return the amount of illicit earnings of VND 600 million to the state budget. Defendants: Nguyen Phuoc Thinh, Do Van Gioi and Nguyen Thanh Xuan: 8 years in prison. Defendants: Le Van Duong Em, Do Quoc Thinh, Cao Van Thinh, Dinh Van Duc: 7 years in prison.
Group of crimes of illegal possession of narcotics: Tran Ngoc Tai: 4 years in prison; Dang Trung Nghia: 1 year and 6 months in prison; Tran Thi Quynh: 1 year in prison; Nguyen Thi Mong Dang: 9 months in prison. Nguyen Van Sang was only sentenced to 9 months in prison for failing to report a crime.
After that, the defendants Tran Ngoc Phuc, Nguyen Phuoc Thinh, Do Van Gioi, Nguyen Thanh Xuan and Do Quoc Thinh appealed for the reduction of the sentence. Tran Thi Quynh, Nguyen Thi Mong Dang and Nguyen Quang Sang appeal for suspended sentences.
Speaking at the appeal trial, the high representative of the VKSND said that the criminal acts of the defendant endanger society, the first instance verdict has handled the right person and the right crime. Therefore, the VKS representative proposed to reject the entire appeal, keeping the first instance verdict intact.
