For the opinion of the lawyers – the proposal to exempt the defendants from criminal responsibility, the Panel considers that there is no basis.

Nguyen Hoai Nam received 4 years in prison; Truong Van Ut 3 years in prison, combined with the previous sentence.
Le Thi Thanh Thuy was sentenced to 5 years in prison.
The Panel obliged Lavenue Investment Joint Stock Company to return to the State the originals of the Land Use Right Certificates No. 8-12 Le Duan.

During the trial process, Mr. Tai admitted that he violated the regulations because he was impatient to implement the project, that it was delayed too long, not because he “had private feelings” for Thuy or had a profit motive. Also, Thuy repeatedly stated that he did not have an emotional relationship with Mr. Tai, participating in the project as a “business invited by the city to invest.”
Defending the defendants, the lawyer said that the case has not caused damages, he proposed to the Panel to review the allegations of the VKS, applying Clause 1 of Article 29 to exempt Mr. Tai and his accomplices from criminal responsibility.
