Currently, Mr. Nguyen Thanh Tai is on trial by the Ho Chi Minh City People’s Court for an 8-12 Le Duan land-related violation that resulted in a loss of VND 1.927 billion.
According to the conclusion of the investigation, Diep Bach Duong Company (due to the defendant Duong Thi Bach Diep) and the Light Music Center (dependent on the Department of Culture, Sports and Tourism of Ho Chi Minh City) were assigned to manage the headquarters in 185 Hai Ba Trung. Due to the deterioration of this facility, in 2007 the Light Music Center contacted the company Diep Bach Duong to cooperate in the investment and improvement of the venue.
Ms. Diep proposed to the center to find another equivalent property to exchange. This exchange allows Diep Bach Duong Company to receive the 185 Hai Ba Trung land and merge with the existing land to build a hotel and restaurant complex. In return, Diep Bach Duong Company will support the center to build the center at another suitable location. Seeing a reasonable plan, Mr. Vy Nhat Tao (director of the Light Music Center in Ho Chi Minh City) agreed to this exchange plan.
Then, in February 2008, Ms Diep found land at 57 Cao Thang (District 3, Ho Chi Minh City) and submitted a request to exchange assets to the Ho Chi Minh City People’s Committee and related agencies to request the exchange of lands 57 Cao Thang for lands. 185 Hai Ba Trung and Diep Bach Duong Company will support the Center for Light Music for VND 5 billion. However, given this proposal, city leaders do not accept the exchange because the law does not have this provision.
Subsequently, Ms Diep continued to mobilize authorized persons for the redemption plan along with the Light Music Center repair proposal in the amount of VND 20 billion. After that, Mr. Vy Nhat Tao invited Mr. Nguyen Thanh Rum to visit Cao Thang site 57 and introduced Mr. Rum to the benefits of the Light Music Center. Mr. Rum held a meeting of the department’s board of directors and agreed to the exchange policy.
After that, Ms Diep signed a mortgage contract with 57 Cao Thang to borrow 21,860 taels of gold from Agribank. This loan, Bach Duong Diep Company did not inform Mr. Vy Nhat Tao.
After that, Ms. Diep met with Mr. Nguyen Thanh Tai directly to propose to present the exchange plan, then Mr. Tai met with the Chairman of the Ho Chi Minh City People’s Committee (at that time Le Hoang Quan) for consultation. The president of Ho Chi Minh City then approved the swap, but it must go through the Finance Department, the Steering Committee of 09 proposals. Mr. Tai has directed the relevant agencies to do this.
The Finance Department held 2 related meetings, but Ms. Diep did not provide any information on the mortgage on the real estate at 57 Cao Thang. Ms. Diep only pledged to support an additional VND 5 billion for the repair of the facility.
After that, the exchange file was approved by the Ho Chi Minh City People’s Committee on the condition that Diep Bach Duong Company be responsible for building a new standard music center at 57 Cao Thang (included in the use value of land after expertise).
Regarding the value of the land use rights, after appraisal, if any parcel of land is more valuable, the recipient must reimburse the difference to the other party. Once the appraisal is finalized, the Diep Bach Duong company, in addition to building the headquarters, also has to make up the difference of more than 4 billion.
After agreeing to the exchange, Diep Bach Duong Company accepted the 185 Hai Ba Trung facilities and related documents, but Ms. Diep did not deliver the housing documents at 57 Cao Thang to the Light Music Center.
Due to the difficulty in issuing the certificate, Diep Bach Duong Company requested to cancel the exchange. Then the Ho Chi Minh City Finance Department sent a document to HCM city leaders proposing not to collect an additional amount of more than 4 billion dong, which is determined as the difference in usage rights. from the earth.
After receiving reports from the Finance Department and related agencies, Mr. Le Hoang Quan chaired the meeting with the vice presidents in January 2013 and many other units. At this meeting, Mr. Quan concluded: By agreeing to reimburse VND 5 billion to the Diep Bach Duong company committed to supporting the Light Music Center, and continuing to ask the Diep Bach Duong company to pay more than VND 4 billion. difference of right to use the land.
