The 29 defendants prosecuted by the Hanoi City VKSND in this case all reside in Hoanh Village and Dong Mit Village, Dong Tam Commune, My Duc District.
According to the indictment, the subjects, although they were well acquainted with Senh’s land and Dong Tam commune as a defense ground, were concluded by the Hanoi City Inspector and the Government Inspectorate. After that, the city of Hanoi and the central authorities held a dialogue with the people of Dong Tam commune so that people would understand and ask people to abide by the law.
However, since 2013, Le Dinh Kinh (SN 1936, resident of Hoanh Village, Dong Tam Commune), together with Le Dinh Cong, Nguyen Viet Hieu, Nguyen Van Tuyen and some indigenous peoples of Dong Tam Commune, established a “Consensus Team” with the objective of reclaiming Senh’s copper land was divided. Also according to the indictment, at the meeting at Mr. Le Dinh Kinh’s house on July 6 and January 8, 2020, Mr. Kinh said: “Just kill 3 guys and they will run away.” Le Dinh Cong said: “You don’t have to say much, they go on and hit, I hit first.” Bui Viet Hieu said: “Give the gas bombs and grenades and run away.” Nguyen Van Tuyen said: “If the people want to take over the land, they must arrest all their brothers. I have to kill 100 guys” and the other subjects agreed.
On the morning of January 9, when the police stopped and arrested the offenders who were hiding in the home of Mr. Le Dinh Kinh. Here, the subjects used gasoline bombs, grenades, iron tube knives to fight fiercely. In the process, performing the task, 3 policemen were burned by gasoline bombs, causing death.
When the police entered Mr. Le Dinh Kinh’s house, Mr. Kinh was holding a grenade in his hand and shouting: “I will blow it up, you die.” Therefore, the Working Group opened fire twice, wounding and subsequently killing Mr. Kinh.
The trial charged Mr. Le Dinh Kinh’s actions with the crime of “murder”. However, due to the death of Mr. Le Dinh Kinh, the investigating agency did not mention the treatment.
