The Panel sentenced defendant Phuc to 15 years in prison for “using computer networks, telecommunications networks, electronic means to appropriate property” under Clause 4, Article 290 of the 2015 Penal Code.
According to the indictment of the Provincial People’s Protection Institute of Dak Nong Province, since the beginning of 2020, Nguyen Van Phuc read newspapers and learned through social media that many difficult circumstances were helped by everyone, so there was the intention to seize property. After that, Phuc bought two bank accounts of an unknown person and a junk simulator to commit the crime.
The authorities have identified 23 people whose property was seized by Phuc with a total amount of more than 600 million dong. The most stolen victim is 100 million dong, the least one is 2 million dong. It is worth mentioning that most of the victims of the defendant Phuc are people with extremely difficult circumstances such as cancer, orphans, traffic accidents or dangerous diseases that require urgent treatment costs …
The defendant admitted that many people would help and support the above difficult circumstances, so Phuc used a garbage simulation to contact the victims. The defendant tells the victim that he wants financial help for the circumstances and that he should ask the victim for the account number. At this point, Phuc sent a text message with a link to the victim and said that the international account should force the victim to enter information on this link.
After entering the information in the link, the email from Phuc will receive all the password and bank account from the bank. In this way, the subject obtains the bank information and uses it to steal the victim’s money, then send it to some other account for debt payment or personal consumption.
At the trial, the defendant Phuc confessed to his criminal acts and tricks. Phuc uses Zalo and Facebook accounts and participates in charity groups, at the same time, through articles that exploit information from difficult circumstances.
Through these accounts, Phuc used to buy some bank accounts, e-wallets, then go online to learn how to set up fake websites and then decorate interfaces like some banks’ interfaces to fool victim. In particular, Phuc opposed the voice changer software to make phone calls to deceive victims.
On October 20, 2020, after reading the newspaper and learning that the family of Le Thi Thu Thao (residing in Krong No district, Dak Nong province, the wife of a victim was killed in a landslide in Rao Trang 3 – Thua Thien Hue hydroelectric power station) received money from various philanthropists, Phuc called to trick Thao with the above tricks and claimed 100 million from this victim. On October 25, 2020, Phuc was arrested and detained by the authorities for the aforementioned crime.
