Two drivers face prosecution and points on their driver’s license after they were reportedly caught texting while passing officers from the Devon and Cornwall Highway Police team.
They were passing 10 uniformed police officers who were involved in the investigation of a fatal incident on the M5 in Cullompton, yesterday (September 28).
A spokesperson for the Alliance Roads Police Team, a road police team made up of Devon and Cornwall Police and Dorset Police working under the Alliance Operations Department, wrote on Twitter: “To the 2 drivers this afternoon they head south on the M5 near Tiverton texting on their phones as they pass 10 uniformed police officers dealing with a collision.
“I saw you. I got your registration numbers and you won an award. Prosecution notices planned in the mail.”

Ian nod wrote: “Good news, I almost got killed a few times on my motorcycle when people texting and driving. Remove the driver’s license and crush the car, van, or wagon. It will stop overnight. “

The Devon and Cornwall Police website says the following about using a mobile phone while driving.
- Turn off your mobile device before leaving so you won’t be tempted to use it.
- Do not make or answer calls while driving.
- It is illegal to use a handheld device while driving, even if you have stopped at traffic lights, are in a traffic jam, or are driving slowly in a parking lot.
- No online conversation, text message, or post is more important than a person’s life.
Devon and Cornwall Police added: ‘When caught using a mobile device while driving, you will be issued a fixed penalty notice and receive a £ 200 fine and six points on your license. If you are a relatively new driver or already points penalty on your license, you could end up off-road very quickly incurring six more points.
“Your case could also go to court and you could be disqualified from driving or traveling and receive a maximum fine of £ 1,000. Drivers of buses or freight vehicles could face a maximum fine of £ 2,500.”

It came after police were on the scene investigating a fatal incident in which one person died.
A spokesman for Devon and Cornwall Police said: “’Police were called today at 12:25 pm to the M5 in Cullompton following concerns for the well-being of a person on the northbound carriageway.
“A person was found on the road who had suffered serious injuries and his death has since been confirmed at the scene.”
