Nicola Sturgeon faces lawsuits to join an attempt to oust Margaret Ferrier after an 800-mile round trip to Parliament while suffering from coronavirus symptoms.
The deputy has yet to resign from the Commons despite having been stripped of the SNP whip and Ms Sturgeon publicly asked him to leave.
Scotland Yard confirmed it was investigating Ferrier’s admission that he traveled 400 miles from Glasgow to London while awaiting test results, then took the train back after being told it was positive.
Ms Ferrier could face a £ 4,000 fine for a first-time offense for coming into contact with other people ‘recklessly’ when she should have been in isolation under a law that went into effect on the day of her positive test.
The Scottish Prime Minister is now under pressure to sign an impeachment petition which could force Mrs Ferrier to quit her £ 82,000 a year job.

Scottish Conservative leader Douglas Ross said today that he is ‘shocked, astonished and dismayed’ that Ferrier has not yet resigned.
He told Sky News’ Sophy Ridge on Sunday that his actions were ‘irresponsible and dangerous’.
Meanwhile, Scottish Labor leader Richard Leonard has said that Sturgeon must support an impeachment petition to remove Ferrier, which could be triggered if she is suspended from the Commons for two weeks.
Under parliamentary rules, the deputy would face by-elections if she signed at least 10 percent of her 81,000 voters.
Ferrier traveled by train to London from Scotland last Monday while waiting for the results of a Covid test taken on Saturday, then returned the next day after being told the test was positive.
Images on her Twitter page showed her in several public places that had likely been busy on a Saturday, including the Vanilla Salon and South Lanarkshire Eastfield Lifestyle Leisure Center in Rutherglen, and the Sweet P gift shop in Burnside.
Spokeswoman Sir Lindsay Hoyle lashed out at her astonishing actions when faced with calls from her own party leader to leave the Commons.
Sturgeon used a series of expletives and said his “head was in his hands” when he was told that his “friend and colleague” had broken the law, the sources told the Times.
However, Ms Ferrier resists calls to resign and may seek to remain in the Commons as an independent, having referred to the parliamentary standards watchdog.

The SNP has insisted that it did not know that Ferrier had tested for Covid-19 on Saturday before traveling to Westminster to participate in a debate on the coronavirus in the House of Commons on Monday.
According to Ms. Ferrier’s own account, she was informed that the test was positive that night.
The Rutherglen and Hamilton West MP said she was screened after experiencing “mild symptoms,” meaning she should have been isolated.
In a statement, he admitted that he traveled to his home in Glasgow on Tuesday, where he has been isolating himself ever since. He apologized for his actions and said “there was no excuse”.
The Metropolitan Police have confirmed that they are investigating the trips together with the British Transport Police for possible violations of the 2020 Health Protection Regulations.
