What happened that night in the Constitutional Court?

Engin Yıldırım, a member of the Constitutional Court, was marching in the courtyard on Tuesday, October 13 as usual.

On that day, the 14th High Criminal Court in Istanbul announced that it did not recognize the Constitutional Court’s decision to retry Enis Berberoğlu and, like all members of the high court, was stunned by Engin Yıldırım.

President Zühtü Arslan invited all members to the meeting on Wednesday night, October 14, to discuss this issue.

Although the meeting gave an extraordinary meaning, the president was actually looking to consult what to do in the face of this contradictory attitude, which is the second time.

Similarly, the high court retrial decision against Şahin Alpay and Mehmet Altan was not followed.

He made the biggest mistake of his life

As Engin Yıldırım was thinking of expressing his reaction to all this at Wednesday’s general assembly meeting, he suddenly saw the court building, which was illuminated during the march, and at that moment another light flashed in his mind. He photographed the building and shared it.

He didn’t realize that he made the biggest mistake of his life at the time, but it didn’t take long for him to realize it.

Journalists and social media users who saw the post were also shocked and another light shone in their minds.

This light was coded as “the lights of the general assembly are on”, it was the message associated with the pulse of the dark periods.

Since then, all social networks and traditional media have focused on this exchange. Engin Yıldırım realized at that moment that he had made the mistake of his life, but it was too late.

Not only journalists, but also the Interior Ministry, political parties and party spokesmen made statements one after another. Everyone reacted very harshly to this exchange, which provoked a coup and called for his resignation.

The president of the court, Zühtü Arslan, who had a hard time after politicians made statements about the court and the local court did not recognize the decision, got into another difficulty with this statement. He asked Engin Yıldırım to make a statement. Engin Yıldırım made a written statement and said:

“The phrase that I used in my post on my personal Twitter account has been interpreted in a way that goes beyond the purpose and I am deeply sorry. My goal was to emphasize that AYM is a light of law. It is out of the question for me to involve all non-democratic formations, media and companies. “

However, this statement did not stop anyone and the reactions grew like an avalanche. On this, the Constitutional Court also needed to make an institutional ruling. The statement read:

“The publications made by any member of the Constitutional Court on their personal social media account do not reflect the institutional vision of the Constitutional Court. As stated by the Constitutional Court in its press release on the night of July 15, 2016, it rejects any undemocratic attack against the constitutional order and defends the democratic constitutional state. “

REACTIONS FROM THE MEMBERS OF THE GENERAL ASSEMBLY

On Wednesday, October 14, the General Assembly of the Constitutional Court began to confront this tension. While the local court’s decision to resist the high court was disputed, the discussion that began with the publication of Engin Yıldırım became the main item on the agenda.

Engin Yıldırım took the floor at the beginning of the meeting. He admitted that what he did was wrong, declared that his reaction to the 14th Criminal Criminal Court, which declared that his intention was not to comply with the decision of the high court, was to react by saying “The Constitutional Court is working.”

The members reacted to this statement and said that a situation had occurred that damaged the reputation of the court. Yıldırım said that he acknowledged his mistake and should think that this explanation could be taken to different places, but his caution was attached. However, he said he never accepted the indications of a coup and the allegations from FETO, and that he would consider this an insult.

Almost all members agreed that what was done was a big mistake. Again, the vast majority said this should be a disciplinary investigation. Some members were noted to have a harsher attitude.

However, all the members did not agree with the idea that this publication was a coup connotation.

THE DISCIPLINARY INVESTIGATION ON ENGİN YILDIRIM WILL BE OPENED

Engin Yıldırım himself admitted that his mistake should be subject to disciplinary investigation and said that he will implement the court’s decision.

Later in the meeting, the situation of the local court was discussed for the second time, which did not implement the higher court’s decision. The chaotic legal environment this can cause was emphasized. However, it was also clear that there was no possibility of sanction in this regard.

In addition, the political debates of which the Constitutional Court was subjected were discussed. On this issue, it was discussed that President Zühtü Arslan should hold talks with the Executive Branch through his own communication channels and contact the powers that be to reduce tension.

As a result, a disciplinary investigation against Engin Yıldırım will be launched next week. There are three possibilities as a result of the investigation:
