The hearing at the 23rd First Instance Criminal Court in Istanbul was attended by the defendant Merve Şarapçıoğlu, who was not arrested, and the complainant Berk Oktay and the party’s lawyers. Plaintiff Berk Oktay said: “My complaint continues. I demand that the accused be punished.” Serdar Öktem, Oktay’s lawyer, also requested that the defendant be punished to the upper limit.
“I DID NOT COMMIT SUCH A CRIME”
Defendant Merve Şarapçıoğlu said: “I did not commit such a crime. I do not accept the accusation. I am also a victim. Based on the evidence in the file, it is obvious that I am innocent.” In his last words, Şarapçıoğlu said: “It is the court of discretion. My innocence is obvious from the evidence on file.” Şarapçıoğlu’s lawyers also stated that there is no reason for their clients to commit this crime and said: “My client does not have access to the Internet at the time. Even no woman or lawyer can take action in the case.”
PENALTY OF 2 YEARS AND 1 MONTH
The court sentenced the defendant Merve Şarapçıoğlu to 2 years’ imprisonment before the lower limit, claiming that he was proven to have committed the crime of “revealing images and sounds of private life”. Considering that the crime was committed in a chain, the court sentenced the penalty to 2 years and 6 months in prison. Taking into account his good conduct at the hearings, the court applied a reduction and sentenced the defendant Şarapçıoğlu to 2 years and 1 month in prison. The court, which did not postpone the sentencing of the defendants, ordered a notification to the 10th Criminal Court of First Instance in Istanbul on the grounds that the announcement of the verdict had been previously applied.

Responding to questions from members of the press in front of the courtroom after the verdict, Berk Oktay said he was threatened with dropping the case and said: “This is my honor case from the beginning and I never backed down on my honor. Thank God, today all the honor of my last name has been clarified. As a result of my trust in time, justice has found its place. This case is a precedent case. I wish it to be an example for all.
CASE BACKGROUND
While the divorce process was ongoing, the social media accounts of Berk Oktay and Merve Şarapçıoğlu were hacked and the intimate photos of the couple were spread on social media. The defendant Merve Şarapçıoğlu, who gave a statement at the first hearing, said: “My personal gmail account and the icloud and instagram accounts registered in this account were hacked. Berk Oktay and several photos of me on my phone were seized. Those who These photos were seized and shared my personal Instagram account 5 minutes apart. These photos were kept open to everyone on my account for 4-5 hours. My private photos were shared on the accounts where those photos were shared. Although it should being a victim in this case, participating as a defendant does not fit in my mind or conscience. “
