Take the attention of the tour package! Fees will be refunded

The Ministry of Commerce made a regulation change in the Official Gazette of those who will cancel their vacations due to the coronavirus pandemic.

Due to the pandemic, participants may submit an application to the travel company and request a refund. Refunds will be paid within 14 days of the flight ban being suspended, 60 days later. Taxes, tariffs and similar legal obligations will decrease the amount to be paid.

DRAFTING REGULATION

ARTICLE 1 – The following temporary article has been added to the Regulations of the Tourist Package Agreements published in the Official Gazette of 01/14/2015 and with the number 29236.

“Termination of contract due to Covid-19 outbreak

PROVISIONAL ARTICLE 1 – (1) It is essential that reimbursements made within the scope of Article 16 of these Regulations are made within fourteen days after the notification of termination reaches the organizer or agent of the tour package. However, due to the COVID-19 epidemic, the price of the flight, which is expected to run as of 5/2/2020 and includes package transportation contracts involving air transportation, has been paid and documented at air transport companies by the tour package organizer or their agent, the sixtieth day after the flight ban has been lifted. It is returned to the participant in the following fourteen days.

(2) Provided the participant is informed and their explicit consent is received, the price paid by the participant will be refunded within fourteen days following the sixtieth day after the flight ban has been lifted, except for taxes, similar legal fees and obligations to pay.

(3) The burden of proof corresponds to the organizer of the tourist package or to the intermediary when informing the participant about the preference of the first or second paragraph in writing or with the permanent manager of the data and obtaining their approval.

ARTICLE 2 – This Regulation enters into force on the date of its publication.

ARTICLE 3 – The provisions of these Regulations are executed by the Minister of Commerce.
